新疆生态环境保护法治化研究

【摘要】： 全文用三部分研究新疆生态环境保护法治化问题。第一部分主要阐述了新疆生态环境保护面临的主要问题及原因。第二部分论述了新疆生态环境保护法治化的基本原则。第三部分提出了新疆生态环境保护法治化的基本对策。认为新疆是我国西北的战略屏障,是我国战略资源的重要基地,其生态环境保护具有十分重要的战略地位。近半个世纪以来,新疆地区的经济得到快速增长,但是由于在经济发展中忽视了生态环境的保护,对生态环境的长期掠夺式开发和利用,造成部分资源接近枯竭,环境污染和破坏已严重威胁到人们的生存和发展。因此,新疆生态环境的保护必须通过法治化的道路来完成,应结合新疆实际,考虑民族地区的利益和特点,以科学发展观为指导原则,坚持法律之上原则,可持续发展原则,统筹规划原则,预防为主、防治结合原则,公众参与原则以及从实际出发等原则,同时借鉴国内外生态环境保护法制建设的经验,从各个方面强化法治的作用,建立健全立法、执法、守法和法律监督为一体的生态环境保护的法治化体系,切实利用法律手段引导、规范、促进和保障新疆生态环境的平衡协调,从而实现经济社会与生态环境保护的和谐发展。
[Abstract]:This paper uses three parts to study the legalization of ecological environment protection in Xinjiang. The first part mainly expounds the main problems and causes of ecological environment protection in Xinjiang. The second part discusses the basic principles of the legalization of ecological environment protection in Xinjiang. The third part puts forward the basic countermeasures of the legalization of ecological environment protection in Xinjiang. It is considered that Xinjiang is the strategic barrier of northwest China and an important base of strategic resources in China, and its ecological environment protection plays a very important strategic role. In the past half century, the economy of Xinjiang has been growing rapidly. however, due to the neglect of the protection of ecological environment in economic development and the long-term predatory development and utilization of ecological environment, some resources are nearly exhausted, and environmental pollution and destruction have seriously threatened people's survival and development. Therefore, the protection of Xinjiang's ecological environment must be completed through the road of legalization, taking into account the interests and characteristics of ethnic minority areas in the light of the reality of Xinjiang, taking the scientific concept of development as the guiding principle, adhering to the principles of legal, sustainable development, overall planning, prevention, prevention and control, public participation, and proceeding from reality. At the same time, drawing lessons from the experience of the legal construction of ecological environment protection at home and abroad, strengthening the role of the rule of law from all aspects, establishing and perfecting the legalized system of ecological environment protection, which integrates legislation, law enforcement, law-abiding and legal supervision, and earnestly using legal means to guide, standardize, promote and ensure the balance and coordination of ecological environment in Xinjiang, so as to realize the harmonious development of economic, social and ecological environment protection.
