中国设立别居制度的法律思考

【摘要】：别居又称分居,是指夫妻双方不解除婚姻关系但解除同居义务的法律制度。别居制度起源于欧洲中世纪的教会法,其在国外已为大多数国家所采用,由于其在司法实践中便于操作,在国外已成为大多数国家的法院判决夫妻婚姻关系终止的主要依据之一,并逐步发展成为近现代一些国家和地区的婚姻家庭立法中的重要组成部分。我国婚姻法为明确规定别居制度,而仅将夫妻分居满两年作为离婚的条件之一,关于在我国是否应设立别居制度,学界存在很大的争议,本文认为别居制度一方面能充分维护婚姻当事人的合法权利,另一方面也更能体现作为我国婚姻法基本原则之一的婚姻自由原则,尤其是保障当事人的离婚自由。虽然法律没有明确规定别居制度,但在我国司法实践中,“试离婚”、事实别居的现象已普遍存在。这说明社会需要有相关的法律制度加以规定,只有法律明文规定,才能既保障当事人的合法婚姻权利,又更好地维护家庭的和谐和社会的稳定。本文从我国的关于别居制度的立法现状出发,通过介绍别居制度的基本情况和国外主要国家关于别居制度的规定,来一步步阐述我国设立别居制度的必要性和可行性,并最终对我国设立别居制度提供一些具体的立法建议,以期尽早实现我国别居制度的法律化。
[Abstract]:Separation, also known as separation, refers to the legal system in which the husband and wife do not dissolve the marital relationship but the obligation of cohabitation. The separation system originated from the church law of the Middle Ages in Europe and has been adopted in most countries abroad. Because it is easy to operate in judicial practice, it has become one of the main grounds for the termination of marital relationship in most countries. And gradually developed into a number of modern countries and regions in the marriage and family legislation an important component. Our country's marriage law for clear provisions of the separate residence system, and only husband and wife separated for two years as one of the conditions for divorce. There is a lot of controversy about whether to set up the alternative residence system in our country. On the one hand, this paper thinks that the alternative residence system can fully protect the legal rights of the marriage parties. On the other hand, it can reflect the principle of freedom of marriage as one of the basic principles of marriage law in our country, especially to protect the freedom of divorce of the parties. Although the law does not specify the system of separate residence, it is in the judicial practice of our country. "trial divorce", the fact of the phenomenon has been widespread, which shows that the society needs to have the relevant legal system to regulate, only the law expressly stipulated, can not only protect the legitimate marriage rights of the parties. And better maintain family harmony and social stability. This article proceeds from the legislation present situation of our country regarding the alternative residence system, through introducing the basic situation of the alternative residence system and the stipulation of the foreign main country about the different residence system. This paper expounds step by step the necessity and feasibility of establishing a separate residence system in our country, and finally provides some specific legislative suggestions for the establishment of a separate residence system in our country, with a view to realizing the legalization of the alternative residence system in our country as soon as possible.
