【摘要】：我们当今的社会是由无数个小的家庭组成的大家庭,因而小家庭的幸福和睦与稳定也会带动整个社会这个大家庭的稳定与和谐发展。但是由于社会的发展和东西方文化的交融等因素影响着个人观念的改变,以及物质文化需求不断的变化,当人们的需求得不到满足时,就会促使离婚的案件屡屡发生,特别是我国改革开放以来,人们的思想解放了,离婚的人数是一年比一年多,离婚的比重也是日益增大,结合我国民政部门印发的《2015年社会服务发展统计公报》中资料显示,2015年全国范围内各级的民政部门以及婚姻登记机构共依法办理的结婚登记数达1224.7万对,这比上年同期下降了6.3%;而同年统计数据显示的办理离婚手续夫妻共有384.1万对,却比上年同期增长了5.6%。1根据最高法此前发布的数,近年来,离婚案件的增多,中国的婚姻家庭纠纷案件始终保持高位运行,截止2015年我国法院审理并结案过的家庭纠纷及离婚案件已近400万件,本人作为一名在职法官在基层法院从事民商事审判工作已有几年,在我院受理的民商事案件中离婚纠纷也占据了全部案件数量的近五分之一,由此可见婚姻纠纷不论在全国还是我所在地区都是主要诉讼纠纷之一,面对逐渐增多的离婚案件总体表现出案件数增多、离婚情形适用法律难、当事人举证不足、审理难度大等局限性。我国现今的裁判离婚的标准是夫妻之间的感情是否破裂。因此对于司法审判者而言,如何能够准确的认定夫妻之间感情是否已经破裂是非常重要的,为了更好的解决这一关键的问题,我通过对2013-2015年我院审理的离婚案件的具体情况的分析,对案件当事人诉请离婚理由;对法官认定离婚判决的过程、依据标准和结论的研究和总结,以及分析各种类型离婚案件的情况和法院在审理离婚案件时所能遇到的难点和困惑,充分运用法律,希望能够提出切实有效的解决途径,进而在此基础上进一步完善并提供一些实务中切实有效的措施和新的解决问题的思路帮助解决离婚纠纷,避免因婚姻家庭问题的处理不周产生新的社会矛盾。
[Abstract]:Our society today is a large family of countless small families. Therefore, the happiness, harmony and stability of the small family will also promote the stability and harmonious development of the whole society, but due to the development of the society and the blend of the eastern and western cultures, and other factors affect the change of personal concepts. As well as the constant changes of material and cultural needs, when people's needs can not be met, will promote divorce cases, especially since China's reform and opening up, people's ideological liberation. The number of divorces is increasing year by year, and the proportion of divorce is increasing day by day, according to the data of 2015 Social Service Development Statistics Bulletin issued by the Civil Affairs Department of our country. In 2015, the number of civil affairs departments and marriage registration agencies at all levels nationwide reached twelve million two hundred and forty-seven thousand in accordance with the law, a decrease of 6.3 percent over the same period last year. In the same year, statistics showed that there were three million eight hundred and forty-one thousand divorce couples, an increase of 5.6.1 in the previous year, according to the Supreme Law. In recent years, the number of divorce cases has increased. China's marriage and family disputes have always maintained a high level of operation. As of 2015, nearly 4 million family disputes and divorce cases have been heard and closed by Chinese courts. As a serving judge, I have been engaged in civil and commercial trial work in the grass-roots courts for several years. Divorce disputes in the civil and commercial cases accepted by our hospital also account for nearly 1/5 of the total number of cases. It can be seen that marriage disputes are one of the main litigation disputes in the country or in my area. In the face of the increasing number of divorce cases, the total number of cases is increasing, and the divorce situation is difficult to apply the law. In our country, the standard of divorce is whether the relationship between husband and wife is broken. Therefore, for the judicial judge. How to accurately identify whether the relationship between husband and wife has broken down is very important, in order to better solve this key problem. Through the analysis of the divorce cases heard in our hospital from 2013 to 2015, I appeal the reasons for divorce to the litigants. According to the research and summary of the standard and conclusion, the paper analyzes the situation of various types of divorce cases and the difficulties and puzzles that the court can meet in the hearing of divorce cases. Fully use the law, hope to be able to put forward practical and effective solutions, and then on this basis to further improve and provide some practical practical and effective measures and new ideas to help resolve divorce disputes. Avoid new social contradictions arising from poor handling of marital and family problems.
