男女平等观念下婚内男性生育权的保护

【摘要】： 随着社会的发展和人们权利意识的增强,出现了了许多以前未曾出现过的新生现象,例如丁克家庭的出现,男性尤其是丈夫的生育权问题越来越多受到关注及随之而来的实践中妻子私自堕胎,丈夫所要高额补偿费的现象开始增多,人工生育技术的实施对传统家庭观念的冲突,夫妻结婚之前生育协议的效力及其违约救济问题,所有这些现象都指向婚姻家庭法中一个基本概念——生育权,而其中一些是现实存在的纠纷,但法院对相关诉讼的态度也截然不同,甚至是矛盾的判决,这给当事人和其他有类似诉求的人造成无所适从的感觉,本是相同或相类似的案件,为何在不同的法院结果却南辕北辙,这说明对于这些新生现象我们还没有形成统一意见,主审法官对这样的问题也研究不够深入,更说明现在我国法制建设的不足,法律相互之间不够协调,基于此我也意识到生育权在现实生活中重要意义,所以准备以此为题,对生育权进行剖析和探讨。文章共分七部分,第一部分阐述男性生育权的确立,此作为铺垫,为下文做准备。作为本文所要探讨的权利,首先要明确男性是否可以成为生育权的权利主体,即生育权的主体范围问题,并肯定了平等的男性生育权的含义。肯定了男性的生育权主体地位,那作为权利,就必然存在权利所赋予的自由和资格,这也是文章第二部分所要探讨的男性生育权的内容问题。作为一种权利必然不是绝对的,别然会受到限制,这中限制又分为法定限制和意定限制或称协议限制,此作为第三部分。权利必然会存在被侵害的可能,生育权也不例外,如何认定侵权,有哪几种形式及如何救济就成为第四部分。第五部分是对目前我国相关立法的不足提出的完善建议。本文通过对生育权相关问题的研究,阐释了现实生活存在的生育权纠纷的解决途径和方法,并运用比较分析的方法,通过借鉴国外立法,提出完善我国有关生育权的相关立法的建议。
[Abstract]:With the development of society and the increasing awareness of people's rights, many new phenomena have appeared, such as the dink family. More and more attention has been paid to the issue of men's reproductive rights, especially the husband's reproductive rights, and in the practice, the wife's private abortion, the phenomenon of the husband's high compensation, and the conflict between the traditional family concept and the implementation of artificial reproductive technology are beginning to increase. The validity of the childbearing agreement before marriage and its remedy for breach of contract all point to a fundamental concept in marriage and family law-reproductive rights, some of which are real disputes, However, the court's attitude towards the relevant litigation is also very different, even contradictory judgments. This creates a sense of confusion among the parties and other people with similar claims. It is originally the same or similar case. Why are the results in different courts different from each other? this shows that we have not yet formed a unified opinion on these new phenomena, that the presiding judge has not studied such issues in depth, and that the current legal system construction in our country is inadequate. The law is not in harmony with each other. Based on this, I also realize the importance of reproductive rights in real life, so I intend to take this as a topic to analyze and discuss reproductive rights. The article is divided into seven parts. The first part expounds the establishment of male reproductive right, which is used as a cushion to prepare for the following. As a right to be discussed in this paper, it is necessary to make clear whether the male can become the right subject of reproductive right. That is, the scope of the subject of reproductive rights, and affirming the meaning of equal male reproductive rights. Affirming the subject status of male reproductive rights, as rights, there must be the freedom and qualifications conferred by rights. This is also the content of the male reproductive rights discussed in the second part of the article. As a right, it is not absolute, and it will not be restricted. In this case, the restrictions are divided into statutory restrictions and consensual restrictions or agreement restrictions. This is the third part. The right is bound to be infringed, the reproductive right is no exception, how to determine the infringement, Which several forms and how relief becomes 4th part. 5th part is to put forward the perfect suggestion to our country related legislation insufficiency. Through the research on the related issues of reproductive rights, this paper explains the ways and methods of resolving the disputes of reproductive rights in real life, and applies the method of comparative analysis to draw lessons from foreign legislation. Put forward the suggestion of consummating the relevant legislation about the right to bear in our country.
