论涉外同性婚姻与我国公共秩序保留制度

【摘要】：2015年6月26日,在Obergefell v.Hodges案中,美国最高法院宣布美国各州应当对同性婚姻予以登记并要求各州承认他州登记的同性婚姻。伴随着该案审判的结束,同性婚姻合法化问题再次成为了学界热议的话题。随着同性恋解放运动的兴起和发展,同性之间的爱恋对社会原有的婚姻制度乃至社会的价值观念都带来了极大的冲击。而公共秩序保留制度正是为了保护社会制度和社会基本道德观念而存在的法律武器。因此同性婚姻在法律上的承认与公共秩序保留制度必将发生激烈的碰撞。笔者试图对有关涉外同性婚姻的处理对策进行分析,在平衡公共秩序与公民个人法益的前提下,进一步考量我国司法实践中的公共秩序保留制度。本文除引言和结论外共分为四个部分;第一部分为用一个涉外婚姻案例引出我国今后在涉外同性婚姻中将面临的焦点问题;第二部分为涉外同性婚姻对我国公共秩序保留制度的挑战,并介绍了法院面临请求承认的同性婚姻在学理上的三种分类方法,在此基础上论述了如果一味拒绝承认涉外同性婚姻所带来的问题;第三部分是对当代公共秩序保留制度的适用趋势的阐述以及国外援引公共秩序保留制度处理同性婚姻案件的方式的评析;第四部分针对我国公共秩序保留制度及对涉外同性婚姻的应对给出相应的建议,包括法理上的建议和具体司法实践中的建议。
[Abstract]:In June 26, 2015, Obergefell v.Hodges case, the Supreme Court of the United States announced that the United States should be on same-sex marriage registration and registration of the state requires States to admit he same-sex marriage. Withthe end of the trial, the legalization of same-sex marriage problems once again become a hot topic in academia. With the rise and development of the gay liberation movement, love the values of same-sex marriage system and the original social society has brought great impact. And the reservation of public order system is a legal weapon to protect the basic social system and social morality and the law. So the same-sex marriage in the recognition and reservation of public order system will change the fierce collision. Try to countermeasures concerning foreign same-sex marriage is analyzed, in the premise of balance of public order and individual interests, further examination The amount retained in the judicial practice of our country's public order system. This paper is divided into four parts except the introduction and conclusion; the first part is the focus of a foreign marriage case in China is facing in the future same-sex marriage, same-sex marriage; the second part is the reservation of public order in our country system challenges. And the court request facing same-sex marriage recognized in three kinds of classification methods based on theory, discusses if blindly refused to recognize about same-sex marriage problems; the third part is the application trend of contemporary system of reservation of public order on the reservation of public order and foreign quoted analyzing system to deal with same-sex marriage the fourth part of the case; and proposes the reservation system of foreign same-sex marriage proposals related to public order in our country, including the legal advice and concrete Suggestions in judicial practice.
