【摘要】：2011年7月4日，《婚姻法司法解释（三）》正式颁布施行，其中第2条对夫妻一方向人民法院起诉请求确认亲子关系存在或不存在的情形进行了规范。但是简单的一条条文显然不能展现亲子关系确定制度的全貌，对于在亲子关系确定制度中占有举足轻重地位的未成年子女最大利益原则和身份占有制度等问题也未有所提及。那么，一系列的问题相应而生。《婚姻法司法解释（三）》第2条的规定是否足以应对当前可能出现的亲子关系确定诉讼？域外法中对亲子关系确定制度的构建是怎么样的？在亲子关系确定诉讼中如何保护未成年子女的利益和稳定的身份占有？本文写作的目的就是通过学界文章的查阅和域外法的考察，，为我国亲子关系确定制度的完善提几点粗浅建议。本文第一部分探究亲子关系确定的历史沿革，借此来理清亲子关系确定制度的发展脉络，了解亲子关系确定制度的发展规律。第二部分着重考察了几个典型国家和地区对亲子关系确定制度的成熟立法，通过比较法考察，归纳出对我国亲子关系确定制度的完善有较大借鉴意义的制度设计。第三部分重点论述了在亲子关系确定制度中的两个重要原则：未成年子女最大利益原则和保护身份占有原则。这两个原则是指导亲子关系确定制度的基本原则，本部分的写作目的就是探究它们的内涵，从而能更好地指导我国的亲子关系确定制度的完善。第四部分基于对《婚姻法司法解释（三）》第2条的分析，指出其不足之处，同时提出我国在亲子关系确定过程中要限制亲子关系确定诉讼的前提，对不同主体和不同类型的亲子关系诉讼区别对待，还要注意把握亲子鉴定的适用尺度。
[Abstract]:In July 4, 2011, "marriage law judicial interpretation (three)" the official promulgation, of which second cases of one direction of the people's court requesting confirmation of the presence or absence of parent-child relationship were the norm. But a simple provision apparently cannot show the parentage determination of the picture, in the parent-child relationship had not determined that holds the principle of the best interests of minor children and identity possession system problems such as the prominent position in the system. Then, a series of problem arises. The judicial interpretation of the marriage law (three) > whether the provisions of article second to cope with the possible current parentage determination proceedings? Foreign law in the construction of parentage determination system what is it? In the parentage determination proceedings to protect the interests of minor children and stable identity possession? The purpose of this article is through academic articles The inspection and the expedition of the extraterritorial law made some superficial suggestions for the improvement of the system for the determination of the relationship between parents and children in China.
The first part of this paper explores the history of the establishment of parent-child relationship, so as to clarify the development context of the paternity determination system and understand the development rule of the paternity determination system.
The second part focuses on several typical countries and regions to establish the mature legislation of paternity determination system. Through comparative study, it sums up the institutional design that has great reference significance for the improvement of the paternity determination system in China.
The third part focuses on the determination of two important principles in the system in the parent-child relationship: the principle of the best interests of minor children and protect the identity of the two principles. The principle of possession is a basic guiding principle for the parentage determination system, the aim is to explore the connotation of them, so as to better guide our parent-child relationship to determine the perfection of the system.
The fourth part is based on the interpretation of the "marriage law judicial analysis section (three) > Second, pointing out its shortcomings, and put forward our country to determine the premise to limit the parentage determination in the proceedings in parent-child relationship of different subjects and different types of parent-child relationship between litigation, but also pay attention to grasp the scale of application of paternity.
