离婚纠纷中婚前按揭房屋的分割探析

【摘要】:随着我国社会主义市场经济的迅速发展,房价不断上涨,所以婚前按揭购房已成为大多数购房者的普遍购房方式。当感情破裂离婚成为必然趋势时,离婚纠纷案件中,有关婚前按揭房屋的产权归属及增值部分分割和补偿的问题成为了争议的焦点。尽管《婚姻法司法解释(三)》对此类问题作出了比较详细的规定,但由于各个部门法之间存在冲突,且法律的完善相对于不断变化的社会生活而言具有滞后性,同时为了平衡各方利益,婚前按揭房屋的权属及其增值部分分割和补偿的问题仍存在争议,依然是理论界和实务界研究的重点。 首先,本文以一个案例引出两个问题:婚前按揭房屋的权属与婚前按揭房屋增值部分的性质及分割;其次,例举了理论界对婚前按揭房屋产权归属的不同观点及司法实践中的不同做法,进而提出自己的观点即影响婚前按揭房屋产权归属的因素。最后,讨论了婚前按揭房屋增值部分在离婚纠纷中的处理,其中分别阐述了婚前按揭房屋的性质、分割及分割时对另一方补偿的计算。另外,对婚前按揭房屋贬值问题进行了分析。
[Abstract]:With the rapid development of socialist market economy in our country, house prices continue to rise, so premarital mortgage purchase has become a common way for most buyers to buy houses. When emotional breakdown divorce becomes an inevitable trend, in divorce disputes, the ownership of property rights and the division and compensation of value-added parts of premarital mortgage houses have become the focus of controversy. Although the Judicial interpretation of Marriage Law (3) makes more detailed provisions on this kind of problems, due to the conflict between various departments and laws, and the perfection of the law relative to the changing social life, at the same time, in order to balance the interests of all parties, the division and compensation of the ownership and value-added part of the mortgage house before marriage is still controversial, which is still the focus of theoretical and practical research. First of all, this paper leads to two problems with a case: the nature and division of the ownership of the premarital mortgage house and the value-added part of the premarital mortgage house; secondly, it gives examples of different viewpoints on the ownership of the property right of the premarital mortgage house and the different practices in judicial practice, and then puts forward its own point of view, that is, the factors that affect the ownership of the property right of the premarital mortgage house. Finally, the treatment of the value-added part of the premarital mortgage house in the divorce dispute is discussed, in which the nature of the premarital mortgage house, the division and the calculation of the compensation of the other party are expounded respectively. In addition, the depreciation of pre-marital mortgage housing was analyzed.
