劳动争议调解机制的构建:北仑经验与启示

【摘要】：对浙江省宁波市北仑区"劳动争议联合调解机制"进行实地研究可以发现,其"一个中心、两种机制、三项制度、四大职能、五类方法"的运作模式,本质上体现一种"合作主义"政策;具体而言,一是兼顾劳动者的权益与民营企业的发展,二是兼顾法治原则与效率原则,三是维护调解自愿与多种选择的权利,四是将自上而下的动员与自下而上的参与有机统合。"北仑经验"的启示是:政劳资三方对话有助于减轻劳动关系紧张,增进社会凝聚力,促进社会团结,促进法律共同体的形成。改革工会组织已经刻不容缓,保障劳工的组织权、集体谈判权和自我行动决定权的实现,加强保护劳工的制度建设。
[Abstract]:In Beilun District of Zhejiang city of Ningbo province labor dispute mediation mechanism combined with "field research can be found, the operation mode of" one center, two mechanisms, three systems, four functions, five kinds of methods ", the essence of a" cooperative "policy; particularly, one is taking into account the development of the rights and interests of workers and private enterprises, the two is to combine the principle of rule of law and the principle of efficiency, the three is to maintain a wide selection of rights and voluntary mediation, four is the mobilization and participation of organic integration from top to bottom. The inspiration from "Beilun experience" is that the three party dialogue between government, labor and capital can help to reduce labor relations tension, enhance social cohesion, promote social solidarity and promote the formation of legal community. It is urgent to reform the trade union organization, to ensure the realization of the labor organization, collective bargaining power and the right to decide on self action, and to strengthen the system construction of labor protection.
