合理规制竞业禁止之思考

【摘要】：从一定意义上说,市场经济是一种人才竞争经济,竞业现象因之而出现。分析竞业现象产生的深层原因是我们了解和合理规制竞业禁止的基础和前提;正确把握竞业禁止的原则是合理规制竞业禁止的关键环节;释解竞业禁止的有关法律规定和缺陷为合理规制竞业禁止指明了方向。通过合理限制竞业禁止、构建诚信机制和强化ADR纠纷解决机制,促进劳动关系和谐发展。
[Abstract]:In a certain sense, market economy is a kind of economic phenomenon because of the talent competition, the competition and competition. The deep reason analysis of the phenomenon is the premise and basis of our understanding and reasonable regulation of the prohibition of business strife; correctly grasp the principle of prohibition of competition is a key link of the prohibition of reasonable regulation of business strife; the relevant provisions of the law interpretation of prohibition and the defect for reasonable regulation of prohibition of the direction. Through reasonable limitation of prohibition, build the integrity mechanism and strengthen the ADR dispute settlement mechanism, promote the harmonious development of labor relations.
