反就业歧视的法律救济制度研究

【摘要】: 就业权是劳动权实现的前提,也是劳动权的直接体现。就业歧视是对就业平等权的侵害。随着人权发展的国际化,反对歧视,保护公民合法的人身、财产权利,保障公民权利的平等成为世界各国普遍关注的热点问题。对于我国来说,随着人才市场供大于求的矛盾的突出,就业歧视越演越烈,严重地影响到了我国的社会生活和公民权利的保障以及市场经济的健康发展,人们的平等观念、法律意识都受到了严重地冲击。不利于经济的可持续发展、不利于劳动者平等地分享经济发展的成果,也给社会公平的彰显及和谐社会的构建带来了阻力。因此,新世纪向法治社会过渡的进程中,解决就业歧视这一社会弊端,加强反就业歧视的立法工作,借鉴国外在反就业歧视方面取得的优秀成果,结合我国实际情况构建适应我国国情的反就业歧视的法律救济制度对于我国当前的发展有着重大地意义。 本文主要从四个部分来探讨反就业歧视救济制度的构建: 第一部分主要是对就业歧视的一般理论分析。从就业歧视的概念入手,首先是结合国际公约以及国外对就业歧视概念的研究现状对就业歧视的概念做了初步的界定并对就业歧视的判断标准做了比较详细的分析。接着根据目前世界各国对就业歧视的理论研究情况,并结合有关的法理学、经济学的理论对就业歧视做了一定的分析。最后根据社会权和平等权原理分析了反就业歧视的权利性质和价值取向。 第二部分主要是分析了我国目前的就业歧视现状。主要是从我国社会实践中比较突出的身份就业歧视、性别就业歧视以及身体健康歧视三种歧视类型进行了分析,并分析了我国就业歧视形成的原因。 第三部分针对我国反就业歧视的现有制度,来指出其中存在的问题。就业歧视在我国各个领域都是普遍存在的:从类别上来说,性别歧视、身体健康歧视、身份歧视等比比皆是;从部门来说,无论是国家机关招录公务员还是企业招录员工,都有不同程度和类别的歧视存在。但是,从近几年我国发生的就业歧视案例可以得知,受歧视者往往救济无门,其就业权得不到有效的保障。因此,在我国要构建反就业歧视的救济制度存在着较大的阻力,需要从立法以及制度构建方面加以努力。 第四部分是文章的主体部分。在这一章里,作者直接切入主题,论述在我国如何构建符合我国国情并能顺应国际反就业歧视潮流的法律救济制度。首先,阐述了我国构建反就业歧视法律救济制度的必要性。然后结合美国、英国、荷兰等国家反就业歧视方面的经验从立法层次、法律主体、司法程序以及行政执法等方面提出了制度的具体设计方案。
[Abstract]:Employment right is the premise of the realization of labor right, but also the direct embodiment of labor right.Employment discrimination is an infringement of the right to equality in employment.With the internationalization of human rights, the protection against discrimination, the protection of citizens' legitimate personal and property rights, and the equality of civil rights have become a hot issue of universal concern in the world.For our country, with the outstanding contradiction of oversupply and demand in the talent market, the employment discrimination is becoming more and more serious, which has seriously affected the social life and the protection of civil rights and the healthy development of the market economy, and the concept of equality of people.Legal consciousness has been seriously impacted.It is not conducive to the sustainable development of the economy, to the equal sharing of the fruits of economic development by workers, and to the manifestation of social fairness and the construction of a harmonious society.Therefore, in the process of transition to a society ruled by law in the new century, we should solve the social malpractice of employment discrimination, strengthen the legislation against employment discrimination, and draw lessons from the outstanding achievements made by foreign countries in the field of employment discrimination.It is of great significance for China's current development to construct an anti-employment discrimination legal relief system in accordance with the actual situation of our country.This paper mainly discusses the construction of anti-employment discrimination relief system from four parts:The first part is the general theoretical analysis of employment discrimination.Starting with the concept of employment discrimination, this paper first makes a preliminary definition of the concept of employment discrimination and makes a more detailed analysis of the judgment standard of employment discrimination, combining with the international conventions and the present research situation of the concept of employment discrimination abroad.Then according to the current situation of theoretical research on employment discrimination in the world, combined with the relevant jurisprudence, economic theory to do a certain analysis of employment discrimination.Finally, according to the principle of social right and equality right, the right nature and value orientation of anti-employment discrimination are analyzed.The second part mainly analyzes the present situation of employment discrimination in China.This paper analyzes three types of discrimination, namely, identity employment discrimination, gender employment discrimination and physical health discrimination, which are prominent in our country's social practice, and analyzes the reasons for the formation of employment discrimination in China.The third part points out the existing problems of anti-employment discrimination in our country.Employment discrimination is widespread in all fields of our country: gender discrimination, physical health discrimination, identity discrimination are everywhere in terms of categories; departments, whether government agencies recruit civil servants or enterprises recruit employees,There are different degrees and types of discrimination.However, from the cases of employment discrimination in China in recent years, the victims of discrimination often have no access to relief, their employment rights can not be effectively protected.Therefore, there is great resistance to the establishment of anti-employment discrimination relief system in our country, which needs to make great efforts from the aspects of legislation and system construction.The fourth part is the main part of the article.In this chapter, the author cuts directly into the theme and discusses how to construct a legal remedy system in our country that conforms to the national conditions of our country and can conform to the international trend of anti-employment discrimination.First of all, it expounds the necessity of constructing the anti-employment discrimination legal remedy system in our country.Then, combining the experience of the United States, Britain, Netherlands and other countries against employment discrimination, this paper puts forward the specific design scheme of the system from the legislative level, the legal subject, the judicial procedure and the administrative law enforcement and so on.
