【摘要】: 进入20世纪,当劳动力作为一种资源活跃在世界市场、国家对经济的干预逐渐加强的时候,涉外雇佣合同不同于普通民商事合同的地位也随之凸显。在跨国的劳务履行过程中,涉外雇佣合同纠纷屡见不鲜,传统的合同冲突法调整已经不足以应对涉外雇佣合同法律适用中所出现的新问题,人们开始意识到处理涉外雇佣合同纠纷必须依靠其特殊的冲突规范,于是各国对这种合同纷纷制定了特殊冲突规范。相比之下,我国的对外劳务合作日益频繁,而在立法上却缺乏相关的冲突规范。从现有的立法上看仅有《中华人民共和国劳动法》和《中华人民共和国劳动合同法》有零星的规定,并且在法律适用上体现出强烈的属地主义倾向。实践证明,这样的选法倾向不仅不利于我国与世界各国劳务合作的发展,也不利于对我国劳动者合法权益的保护。因此,笔者在本文中采用历史分析、实证分析以及比较分析等方法,通过对世界各国的相关立法与司法实践进行考察,探寻涉外雇佣合同法律选择的历史沿革、总结其发展趋势,分析涉外雇佣合同法律适用过程中的强制性规范的适用问题,力图设计出既符合涉外雇佣合同立法趋势、又符合我国具体国情的调整涉外劳动合同(我国立法中没有“雇佣合同”的概念)的冲突规范,以完善我国相关的立法,促进我国国际劳务合作的健康发展,更好维护我国劳动者的合法权益。 本文的结构分为四部分: 第一部分为概述部分,是全文展开论述的基础。通过比较分析的方法,主要介绍了涉外雇用合同概念以及范围,对本文论述的涉外雇佣合同以及在中国法背景下的涉外劳动合同做出说明,同时还分析了涉外雇佣合同的特殊性与复杂性问题。 第二部分主要通过案例、立法例介绍目前世界各国关于涉外雇佣合同各种各样的法律选择方法,通过比较、分析这些法律选择方法,归纳出涉外雇佣合同法冲突法的发展趋势,以求更加合理的法律选择方法。 第三部分是关于与涉外雇佣合同相关的强制性规范适用问题的讨论。笔者通过比较关于适用强制性规范的不同主张和做法,分析利弊,提出自己关于涉外雇佣合同领域强制性规范的性质、效力范围,以及适用原则的见解。 第四部分立足于本国,解决当前涉外劳动争议所存在的问题。首先介绍我国关于涉外劳动合同的适用法律框架及做法,现行《劳动法》、《劳动合同法》第2条与《合同法》第126条冲突的问题,并对这些现有立法做出评价;其次,探讨我国关于涉外劳动合同法律适用的立法指导原则并设计出合理的冲突规范。
[Abstract]:In the 20th century, when the labor force is active in the world market as a kind of resource, and the intervention of the state to the economy is gradually strengthened, the position of the foreign employment contract is different from the ordinary civil and commercial contract.In the process of transnational labor service performance, foreign employment contract disputes are common, the traditional adjustment of contract conflict law is not enough to deal with the new problems in the application of foreign employment contract law.People begin to realize that they must rely on their special conflict rules to deal with the disputes of foreign employment contracts, so many countries have formulated special conflict rules for this kind of contracts.In contrast, China's foreign labor cooperation is increasingly frequent, but the lack of legislation related to conflict norms.Only the Labor Law of the people's Republic of China and the Labor contract Law of the people's Republic of China have sporadic provisions, and the application of the law shows a strong tendency of territorialism.Practice has proved that the tendency of choosing laws is not only unfavorable to the development of labor cooperation between China and other countries, but also unfavorable to the protection of the legitimate rights and interests of Chinese workers.Therefore, in this paper, by means of historical analysis, empirical analysis and comparative analysis, the author investigates the relevant legislation and judicial practice of various countries in the world, and explores the historical evolution of the choice of foreign employment contract law.Summing up its development trend, analyzing the application of mandatory norms in the process of applying foreign employment contract law, and trying to design a legislative trend that accords with the foreign employment contract.In order to perfect the relevant legislation of our country and promote the healthy development of international labor cooperation, we should adjust the conflict norms of foreign labor contracts (there is no concept of "employment contract" in our country's legislation) in accordance with the specific conditions of our country.Better safeguard the legitimate rights and interests of Chinese workers.The structure of this paper is divided into four parts:The first part is an overview, which is the basis of the full text.By means of comparative analysis, this paper mainly introduces the concept and scope of foreign-related employment contract, explains the foreign-related employment contract discussed in this paper and the foreign-related labor contract under the background of Chinese law.At the same time, it analyzes the particularity and complexity of foreign employment contract.The second part mainly through the case, the legislative example introduces the various legal choice methods about the foreign employment contract in the world at present, through the comparison, analyzes these law choice methods, induces the development trend of the conflict law of the foreign employment contract law.In order to seek a more reasonable method of law choice.The third part discusses the application of mandatory norms related to foreign employment contracts.By comparing the different opinions and practices on the application of mandatory norms, the author analyzes the advantages and disadvantages, and puts forward his own opinions on the nature, scope of validity and applicable principles of compulsory norms in the field of employment contracts involving foreign nationals.The fourth part is based on our country and solves the problems existing in the current foreign labor disputes.This paper first introduces the applicable legal framework and practice of foreign labor contracts in China, the current Labor Law, Article 2 of the Labor contract Law and Article 126 of the contract Law, and makes an evaluation of these existing legislations.This paper probes into the legislative guiding principles of the application of foreign labor contract laws in China and designs reasonable conflict norms.
