我国智能制造的法律挑战与基本对策研究

【摘要】：智能制造将成为我国实现"大国崛起"的关键一环。为了实现这一蓝图,我国现阶段应当主要通过政策而非法律的方式推动其发展。具体而言,我国应当发挥政府的引导和支持作用,公私协力打造研发平台;应当积极推动科技成果转化;应当扩宽融资渠道,着重促进中小企业和落后地区的科技创新和成果转化。同时,法学界也应当积极面对新的挑战,研究智能制造可能带来的法律问题:企业和个人数据保护问题、法律责任分担问题、网络安全问题、规范平台以防止数据垄断问题、《标准化法》修改问题、劳动法改革问题以及调整既有民法制度等问题。格外需要强调的是,对新问题要勇于"跨界"研究。法学家应当通过与其他领域专家的互动和交流,明确法律手段的适用领域和疆界,以此为《中国制造2025》保驾护航。
[Abstract]:Intelligent manufacturing will become a key link to realize the "rise of great power" in our country. In order to realize this blueprint, our country should promote its development mainly by means of policy rather than law. In particular, China should give full play to the role of the government in guiding and supporting public and private research and development platforms; should actively promote the transformation of scientific and technological achievements; and should broaden its financing channels. Emphasis is placed on promoting scientific and technological innovation and transformation of achievements in small and medium-sized enterprises and backward areas. At the same time, the legal circles should also face the new challenges actively, and study the legal problems that may bring about by intelligent manufacturing: enterprise and personal data protection, legal liability sharing, network security. The standardization platform is to prevent the data monopoly, the revision of the Standardization Law, the reform of the labor law and the adjustment of the existing civil law system. It is particularly important to be brave to "cross-border" research on new issues. Jurists should make clear the applicable areas and boundaries of legal means through interaction and exchange with experts in other fields, so as to protect "made in China 2025".
