《劳动合同法》的立法语言缺陷及完善

【摘要】：语言是人类用于交流的最重要的符号体系,在实际生活中的作用不容小视。立法语言属于语言的一个分支,它是法律文本的文字表意系统,它作为法律信息的载体,对于准确传达立法意图、维护法律权威、实现良法之治有着重要现实意义。按照立法学中立法语言的一般理论,立法语言是指使用于法律、法规和规章中的语言。它是一种非口头语言,是在立法过程中立法者所使用的书面语言,它的语言文字表达体现着立法者的立法意图和立法目的。规范的立法语言应该符合以下基本要求:第一,立法语言应该准确、简洁。第二,立法语言应当具有可操作性;第三,立法语言应当明确具体、通俗易懂;第四,立法语言应当严谨规范。我国《劳动合同法》在出台颁布前虽然经过数次修改,但结合立法语言的一般理论和立法语言规范化的基本要求,我国《劳动合同法》在立法语言方面还存在形式上和实质上的缺陷。形式上的缺陷具体表现有逻辑问题、语法问题、标点符号错误。实质上的缺陷具体表现有语义模糊、语言歧义、语义晦涩。结合立法语言规范化的基本要求,完善我国《劳动合同法》立法语言应从以下几个方面入手:第一,要转变立法思想;第二,在《立法法》中专门规定立法技术方面的内容;第三,建立完善的立法语言审查体系;第四,提高立法者素质。根据完善我国《劳动合同法》立法语言的基本思路,完善我国《劳动合同法》立法语言的具体措施包括:第一,规范语言表述方式;第二,消除语言歧义;第三,恰当运用模糊语言;第四,立法语言适当通俗化。本文从形式和实质两个方面找出我国《劳动合同法》立法语言上的缺陷并对其产生原因进行了深入分析,从而提出了对我国《劳动合同法》在立法语言完善上的几点具体建议,以期能够对《劳动合同法》立法完善改进工作有所帮助,加快我国《劳动合同法》立法完善的进程,使《劳动合同法》在立法价值在社会生活中得到最大限度的体现和发挥。
[Abstract]:Language is the most important symbolic system for human communication. Legislative language is a branch of language, it is the legal text of the ideographic system, it is the carrier of legal information, for the accurate transmission of legislative intent, maintain the authority of the law, the realization of good law has an important practical significance. According to the general theory of legislative language in legislation, legislative language refers to the language used in laws, regulations and regulations. It is a kind of non-oral language, which is written language used by legislators in the legislative process. Its language and characters express the legislator's legislative intention and legislative purpose. Normative legislative language should meet the following basic requirements: first, legislative language should be accurate and concise. Second, legislative language should be operable; third, legislative language should be specific and easy to understand; fourth, legislative language should be strictly standardized. Although the Labor contract Law of our country was revised several times before its promulgation, it combines the general theory of legislative language and the basic requirements of standardization of legislative language. China's Labor contract Law also has formal and substantive defects in the legislative language. Formal defects include logic problems, grammatical problems and punctuation errors. The defects in essence include semantic ambiguity, language ambiguity and semantic obscurity. According to the basic requirements of the standardization of the legislative language, we should start with the following aspects to perfect the legislative language of the Labor contract Law of China: first, to change the legislative thought, secondly, to specify the content of the legislative technology in the Legislative Law; Third, establish a perfect legislative language review system; fourth, improve the quality of legislators. According to the basic ideas of perfecting the legislative language of the Labor contract Law of our country, the concrete measures of perfecting the legislative language of the Labor contract Law of our country include: first, standardize the way of language expression; second, disambiguate the language; third, Appropriate use of vague language; fourth, appropriate popularization of legislative language. This paper finds out the defects in the legislative language of the Labor contract Law of our country from the aspects of form and substance, and analyzes its causes, and puts forward some concrete suggestions on the perfection of the legislative language of the Labor contract Law of our country. It is expected to be helpful to the improvement of the legislation of the Labor contract Law, to accelerate the process of the legislative perfection of the Labor contract Law of our country, and to make the legislative value of the contract Law of Labor to be reflected and brought into play to the maximum extent in the social life.
