大学生就业中的给付行政问题研究

【摘要】:给付行政是行政法领域关注的新型的法律制度,这种制度是解决社会矛盾、保障公民权利的重要手段,同时也是政府构建和谐社会的必然选择和价值追求。现阶段国家和政府的职责就是建设公平正义的和谐社会,和谐就必然要求政府在履行社会管理职能时应遵循保障人权和平等公开的原则,积极地解决社会中存在的突出问题,化解会对社会造成危害结果的矛盾。从当前形势看,大学生的就业问题是各个国家比较重视的一个社会问题,大学生是关系中国众多家庭命运的一个特殊群体,若是政府不能把大学生就业的问题解决好,将会增加社会的不稳定因素,损害政府的形象。本文从行政法领域进行分析,明确在大学生的就业问题上,政府负有不可推卸的责任,这也是政府在社会发展进程中建设和谐社会要求的服务型政府的一种重要的使命,而政府在解决大学生就业问题上最重要的手段就是给付行政。 本文试图通过对大学生就业中的给付行政问题的分析,引起人们对给付行政更多的思考,最终更好的把给付行政理论运用到大学生就业及相关实践中去,增强大学生就业的积极性能动性,从而提高大学生的就业率,完善现代政府的服务功能。文章第一章是引言;第二章研究重点是大学生就业中的给付行政概述,通过对给付行政的内涵与功能的论述,本文认为给付行政在大学生就业中的作用是创造平等公开的就业环境以保障大学生就业中的权益,以及提高大学生就业的积极性;第三章的研究重点是给付行政在大学生就业中的现状及其存在问题,本文认为目前存在的主要问题是政府关注程度较低、给付行政的给付能力不强、责任主体模糊、监督机制缺失,由于这些问题的存在,使得大学生就业中给付行政的作用不能很好发挥,加剧了大学生的就业问题;第四章的研究重点是关于充分发挥给付行政在大学生就业中的作用的建议,本文认为应该确立大学生就业中的给付行政的法律原则,主要包括信赖原则、国家责任原则以及自给与帮助相结合的原则,同时对完善大学生就业中的给付行政制度提出建议。
[Abstract]:The administration of payment is a new legal system in the field of administrative law, which is an important means to solve social contradictions and protect the rights of citizens, and is also the inevitable choice and value pursuit for the government to build a harmonious society. At the present stage, the responsibility of the state and the government is to build a fair and just harmonious society. Harmony inevitably requires the government to abide by the principles of safeguarding human rights and equality and openness in performing its social management functions, and to actively solve the outstanding problems existing in the society. Resolve the contradiction that will cause harm to the society. Judging from the current situation, the employment problem of college students is a social problem that various countries attach more importance to. College students are a special group related to the fate of many families in China. If the government cannot solve the employment problem of college students well, It will increase social instability and damage the image of the government. This paper analyzes from the field of administrative law and makes it clear that the government bears the unshirkable responsibility for the employment of college students, which is also an important mission for the government to build a service-oriented government which is required by the harmonious society in the process of social development. The most important means for the government to solve the employment problem of college students is the administration of payment. Through the analysis of the administrative problems in the employment of college students, this paper tries to make people think more about the administration of payment, and finally better apply the theory of the administration of payment to the employment of college students and the relevant practice. In order to improve the employment rate of college students and improve the service function of the modern government, the initiative of employment of college students should be enhanced. The first chapter of the article is the introduction, the second chapter focuses on the summary of the administration of payment in the employment of college students, through the discussion of the connotation and function of the administration of payment. In this paper, the author thinks that the function of payment administration in the employment of college students is to create an equal and open employment environment to protect the rights and interests of college students in employment, and to improve the enthusiasm of college students in employment. The third chapter focuses on the present situation and existing problems of the administration of payment in the employment of college students. The main problems in this chapter are the low degree of government concern, the weak ability of the administration of payment and the ambiguity of the subject of responsibility. The absence of supervision mechanism, because of the existence of these problems, makes the role of administration in the employment of college students can not play a good role, aggravated the employment problem of college students; The fourth chapter focuses on the suggestion of giving the administration to give full play to the role of college students in employment, this paper believes that we should establish the legal principles of the administration of giving and paying in the employment of college students, mainly including the principle of trust. The principle of state responsibility and the principle of combining self-sufficiency with help are also proposed to improve the administrative system of giving and paying in the employment of college students.
