论工会组织的维护职能

【摘要】： 我国正处于传统的农业社会向工业社会,计划经济体制向市场经济体制的转型期。随着混合经济的发展,市场化的劳动关系基本形成并逐渐占据了主导地位。在已经市场化的领域里,存在大量的违反劳动法律和侵犯工人基本权益的企业,劳动者受侵害的现象比较严重。对作为职工合法权益的代表者和维护者,劳动者群体代言人的工会及其维护职能进行考察,显然也具有现实意义。 本课题首先从工会的职能入手,回顾了我国工会组织在计划经济体制向市场经济体制转型中工会模式的转变历程,即由“生产和维护”的传统二元主义职能模式向“突出维护”的新功能模式;阐述当前工会发挥维权不力的现状;分析了影响工会发挥维护职能的因素,即制约工会维护职能发挥的制度性因素,工会组织自身存在不利于维权的因素,及现有维护劳动者权益的相关法律的不健全等;最后提出了强化工会维护职能的对策,即协调工会与党、政的关系,加强工会自身的改革与建设,完善立法,为工会发挥维护职能构建法制保障,包括《工会法》、《劳动法》等保护劳动者权益的相关法律的修改和完善,及劳动执法的加强等。
[Abstract]:China is in the transition from traditional agricultural society to industrial society and from planned economy system to market economy system. With the development of mixed economy, the market-oriented labor relationship is basically formed and gradually occupied the leading position. In the field of marketization, there are a large number of enterprises violating labor laws and workers' basic rights and interests, and the phenomenon of workers being infringed is quite serious. It is also of practical significance to investigate the trade union as the representative and defender of workers' legitimate rights and interests, and the labor union and its maintenance function. This topic begins with the function of the trade union, and reviews the course of the trade union mode in the transition of the planned economy system to the market economy system in our country. That is, from the traditional dualism function mode of "production and maintenance" to the new function mode of "outstanding maintenance", the paper expounds the current situation of the trade union's weak exertion of its rights, and analyzes the factors that affect the trade union's exerting the maintenance function. That is, the institutional factors that restrict the exertion of the trade union's maintenance function, the factors which are not conducive to the protection of the rights of the trade union itself, and the unsoundness of the existing laws related to the protection of workers' rights and interests, etc. Finally, the countermeasures of strengthening the trade union's maintenance function are proposed. That is, to coordinate the relationship between the trade union and the party and government, to strengthen the reform and construction of the trade union itself, to perfect the legislation, and to build the legal system guarantee for the trade union to play its maintenance function. Including the Trade Union Law, Labor Law and other related laws to protect the rights and interests of workers, and the strengthening of labor law enforcement.
