世界贸易中的劳动法问题

【摘要】：本文就世界贸易中易被人们忽略的劳动力因素和劳动法问题进行了分析，指出一国的劳动法律、政策对其国际贸易会产生不可避免的作用与影响。并从三个方面进一步阐述：一国国内劳动法适用时可能产生的冲突及其解决办法及各国、区际、国际劳动法相互间的整体水平差异也会形成劳动法的法律冲突；不同水平的劳动法并存与发展，说明劳动法作为政治权利与经济利益的复合体，其保护水平受多种因素制约；虽然世界贸易需要劳动法国际一体化，但是这一项目标在较短期内难以实现，况且它对于各国的利弊得失并不相同。
[Abstract]:This paper analyzes the labor factors and labor laws which are easily neglected in world trade, and points out that the labor laws and policies of a country will have an inevitable effect and influence on its international trade. And further elaborated from three aspects: a country's domestic labor law application may produce the conflict and the solution as well as each country, the international labor law mutual overall level difference will also form the labor law conflict; The coexistence and development of different levels of labor law show that as a complex of political rights and economic interests, the level of protection of labor law is restricted by many factors, although international integration of labour law is required in world trade. But this goal is hard to achieve in the short term, and the pros and cons are not the same.
