劳动合同法律属性论

【摘要】:劳动合同是源于罗马法的雇佣契约社会化的结果,劳动关系虽受一定程度的国家干预,但仍属私权关系,劳动契约的有关规范仍属私法范畴,因此我国未来民法典合同篇中应规定雇佣契约章,作为劳动契约法制的基础,以解决学理与实务适用上的困难。
[Abstract]:The labor contract is the result of the socialization of the employment contract from the Roman law. Although the labor relation is interfered by the state to some extent, it still belongs to the private right relation, and the relevant norms of the labor contract still belong to the category of private law. Therefore, the employment contract chapter should be stipulated in the contract text of our country's future civil code, as the foundation of the labor contract legal system, in order to solve the difficulties in the application of theory and practice.
