非全日制用工的法律规制研究
[Abstract]:Part-time employment, as a flexible and atypical form of employment, does not constitute the mainstream form of employment, but under the background of the imbalance between supply and demand in the current labor market, it has an important practical significance to alleviate the employment pressure. With the title of "study on the legal Regulation of Part-time Employment", the purpose of this paper is to explore and solve the problems of labor relationship determination, man-hour management, salary management, social insurance, labor relations dissolution and so on. In practice, the treatment of part-time workers is low and the security system is lacking. How to integrate the legal protection of part-time workers into the labor legal system is the focus of academic research in recent years. This paper probes into the perfection of the legal regulation of part-time employment, first of all, expounds the definition and characteristics of part-time employment, and then reveals the significance of bringing part-time employment into the scope of labor law adjustment. After that, taking the legal risk existing in part-time employment as the starting point and analyzing the problems existing in part-time employment in our country, taking the non-typical nature of part-time employment as the basis of system design, Focus on the protection of the rights and interests of part-time workers. Referring to the foreign legislation on part-time employment, this paper analyzes the impact of part-time employment on the labor market, the comparison of labor benchmarks and the social security treatment of part-time workers. It provides a reference for the improvement of the legal regulation of part-time employment. With regard to the perfection of the specific system, this paper focuses on the determination of part-time labor relations, the man-hour management system, the salary management system, the social insurance system and the reasonable restrictions on the lifting of the labor relations, and so on. Combined with the specific conditions of part-time employment in China, flexible legal norms are used to regulate. Part-time workers and full-time workers are essentially the same. After the legislation has experienced the evolution of its lack-selective adjustment, the legal adjustment of part-time employment will be more perfect.
