罪犯工伤的权利保护

【摘要】： 有关劳动工伤补偿纠纷的处理,相关观点学说众多,而对狱内罪犯工伤补偿问题的研究较少,解决方式的不同不仅对受害人利益的保护会产生不同的结果,而且对弱势群体的保护体现了国家基本道德水平。本文从狱内罪犯劳动的性质、归则原则入手,分析了不同法律法规在这一问题解决上的缺失与矛盾,在通过法理分析的研究基础上,从现有法律条文中找出可行的解决路径,同时,提出了从根本上解决这一问题的方向,得出本文的观点:当前适宜的罪犯工伤补偿方法,就是废止司法部《罪犯工伤补偿条例》,参照《工伤保险条例》标准执行,从制度设计上考虑,是将其纳入国家补偿制度中或国家工伤保险体系中进行系统考虑,以对罪犯这一特殊群体在人身权利方面给以应有的尊重。
[Abstract]:There are many theories about the settlement of labor injury compensation disputes, but there are few researches on the problem of compensation for injuries caused by injuries among prisoners in prison. The different solutions will not only produce different results for the protection of the interests of the victims, but also for the protection of the interests of the victims. And the protection of vulnerable groups reflects the basic moral level of the country. Starting with the nature and principle of criminal labor in prison, this paper analyzes the defects and contradictions of different laws and regulations in solving this problem, and on the basis of legal analysis, finds out the feasible ways to solve this problem from the existing legal provisions. At the same time, the paper puts forward the direction of solving this problem fundamentally, and draws the opinion of this paper: the current suitable method of compensation for industrial injury of criminals is to abolish the regulations of the Ministry of Justice on Industrial injury compensation for criminals, and to carry out according to the Standard of the regulations on Industrial injury Insurance. Considering from the system design, it should be taken into account systematically in the national compensation system or the national industrial injury insurance system in order to give due respect to the personal rights of this special group of criminals.
