法律文化语境视角下中文立法文本翻译的语用充实

　　翻译是一种跨语言跨文化的交际活动,因此,文化语境对翻译的影响是不容忽视的。随着中国和英美国家之间政治、经济、贸易的交流日益密切,其涉及的法律事务也越来越多,使得立法文本的翻译显得尤为重要。中国和英美国家之间的法律文化差异导致法律概念不对等、语言表达不一致等现象。因此,译者在立法文本的翻译过程中要充分考虑立法文本所依赖的法律文化语境,对不确定的语义信息进行合理的语用加工,即语用充实。语用充实属于词汇语用学的研究范畴,是交际者在交际过程中根据语境对言语刺激进行某种程度的语用加工过程。语用充实包括词语、结构甚至整个话语在特定语境下的语用充实。本文基于中文立法文本和英文立法文本之间法律文化语境因素的差异,试图从法律文化语境的视角分析中文立法文本翻译中的语用充实现象。首先,本文简要介绍了法的历史、法律体系、思维方式、宗教及法律语言的运用这几种法律文化因素,并进一步分析了英汉法律文化语境因素的差异。然后,基于塞凯伊罗斯(Sequeiros)语用充实的分类,本文从法律文化语境的视角探讨中文立法文本翻译中的语用充实:时间类和空间类的充实、主题角色的充实、语篇关系的充实及含义的充实。通过分析中文立法文本...
