基于情态理论的汉语立法文本中的情态意义翻译质量评估

本文以韩礼德的情态理论为理论基础,探讨了汉英立法文本翻译中情态意义的翻译质量问题。本研究的目的在于通过评估汉语立法文本中的情态意义翻译质量来发现其中存在的翻译问题并提出解决办法以期提高法律文本翻译质量。 根据韩礼德的情态理论,情态指的是说话人或作者对交换的命题或信息的态度,是传达人际功能的主要语义载体,能反映交际双方的人际关系。情态又分为两种:情态和意态。他还确定了三种情态量值:情态高值、情态中值和情态低值。在法律文本翻译过程中,译文的人际功能应与原文的人际功能对等,这样才能保留原文的法律意图,以保证在司法实践中原文与译文能产生相同的法律效力。 本文通过借用情态理论中的两个参数:情态类型和情态量值,利用描写和对比分析的研究方法从词汇层面对汉语立法文本中的情态意义翻译质量进行了评估。研究结果发现一些因素影响翻译质量,包括言语功能的判断、情态类型与情态量值的选择。结果还表明,情态翻译质量高于意态翻译质量,许多意态翻译失误是由于译者对隐含性法律言语功能判断有误,情态量值选择也没有得到足够重视。有鉴于此,作者提出一些建议以期进一步提高法律文本翻译质量。
