向公众传播权的立法构想

【摘要】：我国《著作权法》第三次修法过程中对广播权和信息网络传播权的修改几易其稿,而司法实践中这两项权利也引发了很大的争议。无论是广播权还是信息网络传播权,实际上都属于法理上的向公众传播权。虽然我国并没有规定一项总的向公众传播权,但该项权利在《伯尔尼公约》和WCT等国际公约中已经得以确立。参考各国的相关立法模式,美国用发行权和公开表演权来规制向公众传播行为的立法模式太过繁杂,欧盟等国家和地区采用的相关立法模式最具可行性,根据后者的立法和司法实践,界定"向公众传播权"的范围需要考虑两个要件,即"传播"和"公众"。应当尝试在我国《著作权法》中设立总括性的"向公众传播权",同时可以在该项权利之下将一些较为成熟且类型化的子权利进行列举。
[Abstract]:In the course of the third revision of the copyright Law in our country, the right to broadcast and the right to spread information on the Internet are amended in several ways. In judicial practice, these two rights have also aroused great controversy, whether broadcast rights or the right to spread information on the Internet. In fact, all belong to the right of communication to the public in legal theory, although our country has not stipulated a general right of communication to the public. However, this right has been established in the Bern Convention and WCT and other international conventions. The United States uses the right of circulation and public performance to regulate the behavior of communication to the public, the legislative model is too complicated, the European Union and other countries and regions to adopt the most feasible legislative model, according to the latter legislation and judicial practice. To define the scope of "the right to communicate to the public" needs to consider two elements, that is, "communication" and "public". We should try to establish the omnibus "right of communication to the public" in the copyright Law of our country. At the same time, some mature and typed sub-rights can be listed under this right.
