论商标显著性的认定

【摘要】：商标显著性虽是一个传统的理论议题,但对于商标的影响却从未减弱,它是商标注册的要件,也是商标保护的灵魂。本文以商标显著性的认定为立足点,介绍显著性的理论内涵,分析显著性国内外的认定现状,探究我国显著性规定存在的不足,提出完善显著性认定的标准,并延伸阐述近似商标显著性的认定,总结近似商标显著性的判断标准。因此,本文主要包括四个部分:第一部分是对商标显著性的理论分析,主要阐述了显著性的分类,显著性与创造性、独创性的比较,获得显著性即商标第二含义的生成机理等,此部分实为后面的论述做理论铺垫。第二部分主要介绍美国、欧盟和日本对商标显著性的规定,分析各国的认定现状,总结国外在显著性认定上采用的标准及存在的可鉴之处,比较分析国内外显著性的认定凸显我国在此方面存在的不足,外国的经验对我国显著性认定标准的完善具有借鉴作用。第三部分是文章的核心,论述商标显著性认定标准的完善,主要涉及传统商标显著性即固有显著性及获得显著性的认定,特殊商标显著性具体包括颜色商标、立体商标及非视觉商标显著性的认定。最后提出我国对商标显著性的认定标准,即应该从相关消费者的角度衡量某一标志是否具有指示商品或服务来源的功能,并考虑消费者的范围、注意力程度等要素,此外还应结合商标指定使用商品的时间、方式,商标所指代商品的价值,社会的一般观念等动态因素进行综合考虑。第四部分是关于近似商标显著性的认定,此部分是文章的创新所在,从实践的高度探讨显著性在近似商标认定中的地位,通过介绍案例展开论述相关消费者认定标准在近似商标显著性认定中的运用,最后总结近似商标显著性的判断标准。
[Abstract]:Trademark distinctiveness is a traditional theoretical issue, but for the influence of trademark is never less, it is the requirement of trademark registration, trademark protection is the soul. The trademark was based on the theoretical connotation, introduced the significant analysis of the status quo, that was both at home and abroad, exploring the problems significant provisions of our country, put forward to improve the standard of the identification of significant, and this approximate trademark was extended, summarize the approximate judgment standard of trademark distinctiveness. Therefore, this article mainly includes four parts: the first part is the analysis of the distinctiveness of the theory, mainly discusses the classification of significant, significant creativity and originality of the comparison, obtained significant trademark second meaning generation mechanism, this part is the following discussion to pave the way.
The second part mainly introduces the United States, the European Union and Japan provisions of trademark significance, status identification and analysis of various countries, summarizing the standard was identified by and existing references, comparative analysis of the problem of identification at home and abroad were highlighted in this area of our existence, the experience of foreign identification with reference standard to improve significantly in China.
The third part is the core of the paper, discusses that the distinctiveness of the perfection of the standards, mainly related to the traditional trademark distinctiveness is the inherent distinctiveness and identification was significant, including special distinctiveness of trademark color, stereoscopic trademark and identification of non visual distinctiveness. Finally proposed our country recognized standards of trademark distinctiveness that is, from the consumer's point of view should be a mark indicating whether to measure the source of goods or service function, and consider the scope of the consumer, the attention degree and other factors, should also be combined with the trademark goods specified time, trademark refers to the value of the goods, the general concept of dynamic factors of social comprehensive consideration.
The fourth part is the identification of the approximate trademark distinctiveness, this part is the innovation of this article, from the height of the practice was in approximate position of the trademarks, through the introduction of the case and discusses related consumer standards in the approximate determination of the distinctiveness of trademark use, finally summarizes the approximate judgment standard of trademark distinctiveness.
