版权制度固有矛盾的调和研究——基于传播技术革新下美国唱片业维权的反思

【摘要】：人为的作品专有秩序同相对独立的作品传播之间的矛盾是版权制度的固有矛盾,传播技术革新则激化了这一固有矛盾。21世纪以来美国唱片业的维权历程表明仅依靠健全的版权制度已不足以维持作品专有秩序。为维护版权秩序、维持版权制度的持续运作,需调和版权制度的固有矛盾。调和固有矛盾的出路在于保障权利顺利流转并为最有效利用者掌握,使合法的作品传播服务能够通过市场竞争压倒非法的作品传播行为。为保障权利流转,需在市场环境下处理版权与技术关系、维权费用分担、新旧版权产业竞争这三大问题。在中国,调和音乐作品版权保护固有矛盾的重点是以市场为基础,综合运用市场、行政与立法手段解决维权费用分担问题。
[Abstract]:The contradiction between the exclusive order of artificial works and the relatively independent dissemination of works is the inherent contradiction of copyright system. The history of the American record industry since the 21st century shows that it is not enough to rely on a sound copyright system to maintain the exclusive order of works. To maintain the continuous operation of copyright system, it is necessary to reconcile the inherent contradiction of copyright system. In order to protect the circulation of rights, it is necessary to deal with the relationship between copyright and technology in the market environment and share the cost of rights protection. In China, the focal point of reconciling the inherent contradiction of copyright protection of music works is to use the market as the basis, comprehensively use the market, administrative and legislative means to solve the problem of sharing the rights of rights.
