以“人肉搜索”为视角对我国个人信息权保护的反思

【摘要】：十八届三中全会审议通过了《中共中央关于全面深化改革若干重大问题的决定》,将网络治理提升到空前的高度。随着科学技术的进步,尤其是数字技术和信息技术的迅猛发展和广泛运用,"人肉搜索"这一网络现象突出。其一方面发挥着舆论监督的作用,同时也使得个人信息权的保护面临着前所未有的严峻挑战。因此,本文从界定"人肉搜索"的法律性质入手,深入探讨与其密切相关的个人信息权受到的冲击,寻找其中存在的法律规制漏洞,并通过对比全球治理环境下个人信息权监管及保护的相关措施,最终落脚于个人信息权保护的法律治理路径。随着我国"一带一路"进程的推进,网络信息的区域性和全球性交流增多,我国迫切需要加大对个人信息权的保护力度,做到在信息时代的全球化浪潮中掌握主动权。
[Abstract]:The third Plenary session of the 18 CPC Central Committee deliberated and adopted the "decision of the CPC Central Committee on comprehensively deepening several important issues of Reform", which raised network governance to an unprecedented height. With the progress of science and technology, Especially with the rapid development and wide application of digital technology and information technology, the network phenomenon of "human flesh search" is prominent. On the one hand, it plays the role of public opinion supervision. At the same time, it also makes the protection of personal information right face unprecedented severe challenge. Therefore, this paper begins with defining the legal nature of "human flesh search", and deeply discusses the impact on the right to personal information, which is closely related to the right to personal information. Looking for the loopholes in the legal regulation, and comparing the relevant measures of the supervision and protection of personal information right under the global governance environment, With the advancement of "Belt and Road" in our country, the regional and global exchange of network information is increasing, so our country urgently needs to strengthen the protection of personal information right. In the information age of the wave of globalization to master the initiative.
