受害人特殊体质的损害赔偿责任实例研究

【摘要】：正常情况下,侵权行为导致损害后果时,侵权者只对自己侵权行为所导致的损害后果承担赔偿责任,但是,当侵害对象系特殊体质受害人时,由于受害人的特殊体质原因所引起的损害后果的扩大或加重时,侵权者是否对特殊体质所导致的扩大或加重的损害后果承担赔偿责任呢?本文通过案例分析和学理论证,提出应当考虑受害人的特殊体质原因,认定侵权者对其行为所导致的严重损害后果承担赔偿责任的观点。本文除开引言,共有四个部分。引言,阐明本文的选题意义及研究综述等。第一部分,问题的缘起。分析、归纳特殊体质受害人案例的基础上,发现由于受害人特殊体质的病理作用,侵权行为经常会导致特殊体质受害人遭受到的损害后果扩大或者加重,这种情况下,笔者认为,侵权行为和特殊体质的病理作用下导致扩大或者加重了损害后果时,特殊体质应当作为归责的依据,认定侵权行为人承担损害后果的扩大或者加重的赔偿责任。第二部分,分别从法理基础及现实需要的角度,对特殊体质应当作为归责依据的必要性进行论述。第三部分,该部分从保障特殊体质受害人权益的角度,主要从法律公正价值的实现以及充分救济特殊体质受害人权利等方面,论证了特殊体质应当作为归责依据的正当性。第四部分,根据实例分析和学理论证,笔者提出了,坚持公正归责原则的基础上,综合考量特殊体受害人侵权案件归责的各种因素,既要坚持特殊体质作为归责的依据,充分保障特殊体质受害人的权益,也要考虑到部分案件的特殊性,公正地追究侵权者的损害赔偿责任,实现特殊案件的正义。
[Abstract]:Normally, when the tort results in the damage, the infringer is only liable for the damage caused by his own tort. However, when the infringer is the victim of a special constitution, When the damage caused by the special constitution of the victim is enlarged or aggravated, will the infringer be liable for the damage caused by the special constitution? Through case analysis and theoretical evidence, this paper puts forward that the special physical reasons of the victim should be considered, and that the infringer should be held liable for the consequences of serious damage caused by his actions. In addition to the introduction, there are four parts in this paper. The first part, the origin of the problem, the analysis, the induction of the case of the victims of special physique, found that because of the pathological role of the victim's special physique, Torts often lead to the expansion or aggravation of the damage suffered by the victims of special constitution. In this case, the author believes that when the damage is expanded or aggravated by the pathological action of the tort and the special constitution, The special constitution should be regarded as the basis of imputation, and the tortfeasor shall bear the expanded or aggravated liability for damages. The third part, from the angle of protecting the rights and interests of the victims of the special constitution, mainly from the realization of the value of legal justice and the full relief of the rights of the victims of the special constitution, etc. This paper demonstrates the legitimacy of the special constitution as the basis for imputation. Part 4th, based on the analysis of examples and theoretical evidence, the author puts forward that, on the basis of the principle of fair imputation, Considering comprehensively the various factors of imputation in tort cases of victims of special body, we should not only insist on special constitution as the basis for imputation, fully protect the rights and interests of victims of special constitution, but also take into account the particularity of some cases. Just investigate the tortfeasor's liability for damages and realize the justice of special cases.
