【摘要】：海外代购是一种随着经济、文化全球化发展而产生的特殊购物模式,同时也是电子商务的一个新兴分支行业。随着电子商务的日益成熟,海外代购已经成为人们日常生活的一部分,在被广大消费者追捧的同时,海外代购也面临法律上的滞后、监管上的漏洞等问题。近来,一系列代购纠纷、代购侵权事件的发生,使得海外代购的规范和监管问题成为社会热点,其中消费者权益的保护也引起了人们的普遍关注。尽管我国关于消费者权益保护的法律制度正在不断完善中,但针对电子商务的法律法规仍然较少,其中有关海外代购中消费者权益保护的法律制度几乎没有,消费者之权益保护依旧面临着严峻的挑战。基于全面保护海外代购中消费者权益的目的,有必要对海外代购的概念、特征、种类、发展现状及原因、消费者的概念、不同主体之间的法律关系等进行全面分析。同时,在理论研究的基础上,需要从实践入手,全面分析海外代购中消费者权益保护存在的问题,针对消费者知悉真情权、公平交易权、赔偿请求权、反悔权等遭遇侵害的现实情况,有必要尽快完善海外代购监督管理制度、完善代购产品责任法律制度、完善消费者权利救济制度,使海外代购消费领域中消费者的合法权益得到有效保护。
[Abstract]:Overseas daigou is a special shopping mode with the development of economic and cultural globalization, and it is also a new branch of e-commerce. Overseas daigou has become a part of people's daily life. While it has been sought after by the broad masses of consumers, overseas daigou is also facing problems such as legal lag and loopholes in supervision. Recently, a series of daigou disputes and violations of daigou have taken place. The regulation and supervision of overseas purchasing has become a hot topic in the society, and the protection of consumers' rights and interests has also aroused widespread concern. Although the legal system of consumer rights protection in our country is constantly improving, However, there are still few laws and regulations on electronic commerce. Among them, there is almost no legal system for the protection of consumers' rights and interests in overseas purchasing. The protection of consumers' rights and interests is still facing severe challenges. In order to protect the rights and interests of consumers in overseas daigou, it is necessary to study the concept, characteristics, types, development status and reasons of overseas daigou, and the concept of consumers. At the same time, on the basis of theoretical research, it is necessary to comprehensively analyze the problems existing in the protection of consumers' rights and interests in overseas daigou, in view of the right of consumers to know the truth, on the basis of theoretical research. The right to fair trade, the right to claim for compensation, the right to reverse regret, and so on have been infringed upon. It is necessary to improve the supervision and management system of overseas daigou as soon as possible, the legal system of product liability for daigou, and the relief system of consumer rights as soon as possible. The legitimate rights and interests of consumers in the field of overseas purchasing and consumption will be effectively protected.
