“一带一路”战略下中国高铁“走出去”知识产权法律问题分析

【摘要】：在"一带一路"战略的推动下,我国海外投资与合作项目越来越多,尤其是随着高铁建设步伐的加快,也使得"高铁走出去"成为"一带一路"战略的助推力。但与此同时,复杂的东道国投资背景以及可能遭遇的有关知识产权风险也可能会为高铁"走出去"的顺利发展竖起一道屏障。鉴于此,本文通过对高铁"走出去"战略可能涉及的知识产权法律问题进行分析,并且就争端的解决提出相应对策,更利于充分了解东道国投资环境进行风险预警,防范知识产权风险,面对争端积极解决,为海外投资保驾护航。
[Abstract]:Driven by the strategy of "Belt and Road", more and more overseas investment and cooperation projects have been carried out in China, especially with the acceleration of the construction of high-speed rail, which has also made "high-speed rail going out" a boost to the strategy of "Belt and Road." but at the same time, The complex investment background of the host country and the intellectual property risks it may encounter may also create a barrier for the smooth development of high-speed rail "going out".
