【摘要】：构建无人继承遗产处理程序有利于保障遗产权利人的利益,也有利于民事关系的顺利流转,充分发挥财产的社会价值。我国目前尚未规定无人继承遗产的处理程序,仅仅规定了它的归属,因此,尽快建立适应我国国情的无人继承遗产处理程序,应成为今后我国完善继承法和民事程序法的主要内容之一。本文对无人继承遗产处理程序构建进行了探讨和研究,以期促进这一程序在我国法律上的确立,从而有助于我国继承制度的不断完善。全文由导论、正文和结语组成。正文分三个部分进行论述:第一部分对无人继承遗产处理程序进行一般性考察。本部分首先介绍了无人继承遗产的概念,并对无人继承遗产与无主财产、无人承认继承的遗产进行比较,目的在于对无人继承遗产有一清晰的界定和全面的掌握。其次,就无人继承遗产处理程序进行域外考察,对其他国家以及港澳台地区的无人继承遗产处理程序的立法特点进行分析比较,目的是通过对其他国家和地区无人继承遗产处理程序的梳理,站在比较法考察的视角上,借鉴和学习其有益经验和成果,从而完善我国相应的法律制度。最后,阐述我国构建无人继承遗产处理程序的必要性,从法理、立法和实践意义这三个角度进行论述。第二部分介绍我国无人继承遗产处理的现状和问题。本部分主要从我国无人继承遗产处理的立法和实践现状进行剖析,进而指出存在的主要问题,目的在于找出立法差距,为构建这一程序寻找突破口。第三部分提出构建我国无人继承遗产处理程序的具体建议。本部分主要从设立遗产管理人的确定程序、设立搜索继承人等的公告程序以及设立无人继承遗产的清算程序这三个方面有针对性地提出了一些建议。以期通过理论分析论证提出相关程序设计来弥补我国现行立法的不足。
[Abstract]:The construction of an uninherited estate processing procedure is conducive to the protection of the interests of the right holder, the smooth circulation of civil relations, and the full play of the social value of the property. It only provides for its attribution, so as to establish as soon as possible a procedure for handling the unattended inheritance of the estate in accordance with the national conditions of our country, It should be one of the main contents of perfecting inheritance law and civil procedure law in our country in the future. This paper probes into and studies the construction of the procedure of dealing with the unattended inheritance in order to promote the establishment of this procedure in the law of our country. This will help to improve the succession system of our country. The text is divided into three parts: the first part makes a general investigation on the procedure of handling the unattended inheritance. Firstly, this part introduces the concept of the uninherited inheritance, and introduces the uninherited inheritance and the unowned property. The purpose of the comparison of unacknowledged inheritance is to have a clear definition and comprehensive grasp of the inheritance. Secondly, to conduct an extraterritorial investigation into the process of handling the unclaimed inheritance. This paper analyzes and compares the legislative characteristics of the uninherited heritage treatment procedures in other countries and areas of Hong Kong, Macao and Taiwan. The purpose of this paper is to analyze the procedures of uninherited inheritance in other countries and regions, and to observe them from the perspective of comparative law. Reference and study its beneficial experience and achievement, thus consummate our country's corresponding legal system. Finally, expound the necessity of constructing the procedure of handling the unattended inheritance in our country, from the legal principle, The second part introduces the present situation and problems of the management of unattended inheritance in our country. This part mainly analyzes the legislation and practice of the treatment of unattended inheritance in our country. And then points out the main problems in order to find out the legislative gap, In the third part, the author puts forward some concrete suggestions on how to construct the procedure of handling the uninherited estate in China. This part mainly starts with the procedure of establishing the administrator of the estate. This paper puts forward some suggestions from three aspects: establishing the announcement procedure of searching for heirs and establishing the liquidation procedure of uninherited inheritance, in order to make up for the deficiency of our country's current legislation by theoretical analysis and argumentation.
