韩国金融消费者权益保护制度对我国的启示

【摘要】:如今随着社会的进步和发展,金融市场也呈现出欣欣向荣的发展局面,金融商品和服务越来越在人们的生活中发挥着重要的作用。金融商品和服务日益复杂化、专业化、丰富化、交易中信息的不对称,以及信息披露不充分、金融消费者与金融机构之间公平交易地位随之不断弱化等原因,使金融消费纠纷呈不断上升的趋势。如今我国虽然建立了相对完善的消费者权益保护体系,但是在实践中没有充分的发挥消费者权益保护的作用,同时,权益保护体系的建立也明显落后于现实需要。在借鉴原有文献之上,拟对韩国的金融消费者保护进行深入学习,并结合分析我国金融消费者保护的现状及不足,借鉴韩国金融消费者权益保护的实践来完善我国的消费者权益保护,保证消费者的纠纷能够及时的得到解决,确保消费者的合法权益得到保证,提高消费者对于金融机构的满意程度,最终保护金融消费者的权益具有重要的现实意义。所谓金融消费者是购买、使用金融产品或接受金融服务的,并且作为非职业性的目的参与到金融活动中,处于金融活动中的弱势群体,并缺乏专业性的金融知识的人或群体。在金融活动中,消费者由于处于弱势地位而得到法律的保护,法律规定,消费者具有的合法权利有:安全权,知情权,组织权,选择权,监督权,公平权,知识获取权,依法求偿权。针对我国的金融消费者权益保护的执行情况,并对其存在的不足之处进行分析,可以发现我国的金融消费者的权益保护方面还存在漏洞,并存在监管不力的情况,向金融机构内部、向消协、“三会”协会投诉、向金融监管机构投诉、申请金融仲裁等救济方式存在着种种缺陷。最后对韩国的金融消费者权益保护制度以及具体实践分析,即韩国金融监督院、韩国消费者院、韩国交易所、韩国金融投资协会的金融消费纠纷调解制度以及金融申诉专员制度,其中韩国的金融申诉专员制度的独立性、快捷性、对金融消费者的倾斜性保护等特点,为我国的金融消费者保护提供了可供借鉴的经验。因此,我国借鉴韩国的金融申诉专员制度,并构建多元化的金融消费者权益保护制度、制定专门的金融消费者权益保护法等,切实保护金融消费者权益。
[Abstract]:Today, with the progress and development of society, the financial market is also showing a thriving development situation. Financial goods and services are playing an increasingly important role in people's lives. Financial goods and services are becoming more and more complex and specialized. Such reasons as enrichment, asymmetry of information in transactions, inadequate disclosure of information, and the weakening of the position of fair trading between financial consumers and financial institutions, and so on, Although China has established a relatively perfect consumer rights protection system, it has not fully played the role of consumer rights and interests protection in practice, at the same time, The establishment of the system of protection of rights and interests also lags behind the needs of reality. On the basis of reference to the original literature, the author intends to study the financial consumer protection in Korea, and analyze the current situation and shortcomings of the protection of financial consumers in China. Learn from the practice of Korean financial consumer rights and interests protection to improve the protection of consumer rights and interests in China, to ensure that consumer disputes can be resolved in time, to ensure that the legitimate rights and interests of consumers are guaranteed. Improving consumer satisfaction with financial institutions and ultimately protecting the rights and interests of financial consumers are of great practical significance. The so-called financial consumers buy, use, or receive financial services. And as a non-professional purpose to participate in financial activities, in the financial activities of the disadvantaged groups, and lack of professional financial knowledge of people or groups. In financial activities, consumers are protected by law because of their weak position. According to the law, the legal rights of consumers are: the right to security, the right to know, the right to organize, the right to choose, the right to supervise, the right to fair, the right to acquire knowledge, the right to claim compensation according to law. By analyzing its shortcomings, we can find that there are still loopholes in the protection of the rights and interests of financial consumers in our country, and that there is a lack of supervision. We can complain to the financial institutions, to the Consumer Association, and to the "three councils" Association. Complaints to financial regulators, applications for financial arbitration and other remedies have various defects. Finally, the system of protecting the rights and interests of financial consumers in South Korea and its specific practice are analyzed, that is, the Korea Financial Supervision Institute, the Korean Consumer House, and the Korean Exchange. The Korea Financial Investment Association's financial consumption dispute mediation system and the financial complaints commissioner system, among them, Korea's financial complaints commissioner system is characterized by its independence, rapidity, and preferential protection for financial consumers. Therefore, our country draws lessons from the financial complaints commissioner system of Korea, constructs the diversified financial consumer rights and interests protection system, and formulates the special financial consumer rights and interests protection law and so on. We will effectively protect the rights and interests of financial consumers.
