电子错误合同的撤销问题研究

【摘要】：随着信息技术的不断发展,网络交易和我们的生活联系越来越密切,电子商务这种贸易方式正在不断的发展,我国电子交易呈现出快速增长的状态,给企业和消费者双方均带来极大的好处。另一方面也出现了许多在电商交易中发生电子错误,从而导致合同在撤销问题上出现纠纷的案例,人们对此议论纷纷。人们大多会使用电脑的电子系统来完成电子订约,但是电子交易中有时会因各种原因产生差错。如果电子系统的一些处理违反了当事人的真实意思表示,那么其所有者或控制者是否也要对此承担责任?如果由于合同当事人的原因出现了电子错误,此时电子合同能否撤销?在各国电子商务活动中,类似的问题并不少见,各国对此类问的解决有着不同的规定。所以在这类问题上的研究将有利于引导中国法院解对此问题的合理解决；有利于给我国电子商务交易活动营造出较好的环境；有利于指引我国电子商务的发展方向。本文从电子错误的表现着手,剖析电子错误的发生缘由和具体分类,讨论发生电子错误的合同的撤销问题,探究完善相关法律规范问题,追求电子错误表意人与其相对人的利益平衡,努力推进我国电子商务活动的规范化发展。
[Abstract]:With the continuous development of information technology, the network transaction and our daily life are more and more close, the electronic commerce is developing continuously, the electronic transaction of our country presents the state of rapid growth. On the other hand, there have been many cases of electronic errors in e-commerce transactions, which have led to disputes over rescission of contracts. People talk about this. Most people use electronic systems of computers to complete electronic contracting, but sometimes errors occur in electronic transactions for various reasons. If some of the processing of electronic systems is contrary to the true meaning of the parties, Is the owner or controller also responsible for this? If there is an electronic error caused by the parties to the contract, can the electronic contract be cancelled at this time? In the electronic commerce activities of various countries, similar problems are not uncommon, and different countries have different regulations on the solution of this kind of question. Therefore, the research on this kind of problem will be helpful to guide the Chinese court to solve the problem reasonably; It is helpful to create a better environment for the electronic commerce transaction in our country and to guide the development direction of the electronic commerce in our country. This paper analyzes the cause and classification of the electronic error from the performance of the electronic error. This paper discusses the revocation of contracts with electronic errors, probes into the perfection of relevant legal norms, pursues the balance between the interests of the ideographers and their counterparts, and makes great efforts to promote the standardized development of electronic commerce activities in China.
