论我国网络购物消费者隐私权的法律保护

【摘要】：随着互联网的迅猛发展,传统的购物模式早已被新型的电子类购物模式所取代,网络购物这种新型的购物方式以其高效、便捷、物美价廉的优势成为人们购物的首选。然而,在人们如火如荼的加入到网购大军的同时,个人隐私信息保护问题也就越来越突出。网络购物消费者隐私信息被泄露、被盗窃、被滥用的现象大量发生。本文以网络购物消费者的隐私权益保护为研究对象,针对新出现的网络购物消费者隐私权保护问题,提出新的保护措施,以期在纯洁我国网络环境和网络购物消费者隐私权的保护中寻求平衡点。本文分四部分对网络购物消费者隐私权的法律保护问题进行了阐述。第一部分阐述了网络购物和网络购物消费者隐私权的基本概念。该部分主要对网络购物的特点、网购中个人信息的使用和侵犯网络购物消费者隐私权的主要方式进行了重点分析。第二部分阐述了我国网络购物消费者隐私权保护存在的问题。主要从立法、司法、行政以及其他方面存在的问题进行阐述。第三部分阐述了国外对网络购物消费者隐私权的保护及对我国的借鉴和启示。该部分主要分析了美国、欧盟和法国在立法中对网络购物消费者隐私权的保护,在此基础上,分析了如何借鉴国外立法经验来完善我国的网络购物消费者隐私权保护制度。第四部分对完善我国网络购物消费者隐私权法律保护的对策和建议进行了阐述。该部分是本文的重点。主要从完善我国网络购物消费者隐私权保护的现有法律和制定专门的网络购物消费者隐私权保护立法、加强对网络购物消费者隐私权的司法救济和行政救济以及完善网络购物消费者隐私权保护的现有对策等方面提出了建议。
[Abstract]:With the rapid development of the Internet, the traditional shopping mode has long been replaced by the new electronic shopping mode. While people are in full swing into the army of online shopping, the problem of protecting personal privacy information is becoming more and more prominent. Privacy information of online shopping consumers is leaked and stolen. The phenomenon of abuse occurs in large quantities. This paper takes the protection of the privacy rights and interests of online shopping consumers as the research object, and puts forward new protection measures for the newly emerging privacy protection of online shopping consumers. In order to seek the balance point between the pure network environment of our country and the protection of the privacy right of the online shopping consumer, this article is divided into four parts to expound the legal protection of the privacy right of the online shopping consumer. The basic concept of online shopping and online shopping consumer privacy. This part mainly deals with the characteristics of online shopping, The use of personal information in online shopping and the main ways of infringing the privacy of online shopping consumers are analyzed in detail. The second part expounds the problems existing in the protection of the privacy of online shopping consumers in our country, mainly from the aspects of legislation, judicature, etc. The third part expounds the protection of online shopping consumer privacy abroad and the reference and inspiration to our country. This part mainly analyzes the United States. On the basis of the European Union and France's legislation on the protection of the right to privacy of consumers of online shopping, This paper analyzes on how to use foreign legislative experience for reference to perfect the privacy protection system of online shopping consumers in China. The fourth part expounds the countermeasures and suggestions for perfecting the legal protection of the privacy rights of online shopping consumers in our country. This part is the focus of this paper. Mainly from perfecting the existing laws of privacy protection of online shopping consumers and formulating special legislation to protect the privacy of online shopping consumers, This paper puts forward some suggestions on how to strengthen the judicial relief and administrative relief to the consumers' privacy right of online shopping and how to perfect the existing countermeasures of protecting the privacy rights of the consumers of online shopping.
