商标代理人的专家责任

【摘要】:商标申请等活动具有较强的专业性,如涉及对拟申请商标是否可能被准予注册的判断,需要大量的相关专业知识和经验,所以在实践中大量的企业和市场主体会选择聘请商标代理人代理其办理商标相关的事项。随着我国经济的发展和社会的进步,一方面,国内企业和各类市场主体也越来越意识到了商标对于企业发展的重要性和经济价值;另一方面,在国内市场对外日益开放的今天,大量外国企业、公司已经或正在进入中国市场,而根据《商标法》的规定,外国企业或者外国公民不能直接在中国申请办理商标注册或者其他与商标相关的行政程序,而必须通过委托商标代理机构进行办理。这些因素促使了我国商标代理行业的蓬勃发展,目前我国商标代理行业也已经较为壮大,上至顶级国际律师事务所,如英国的Magic Circle Law Firms、美国的White Shoes Law Firms,下至街头巷尾的小型商标代理公司,都参与到了商标代理活动中,形成了从高端到低端俱全的市场格局。我国的商标代理市场虽然具有一定的规模,但是仍然是个年轻且不成熟的市场,也存在着大量商标代理人在执业中存在不当行为的现象。而目前我国法律对商标代理人的规定很少,导致相关人的权益无法得到充分的保障。本文针对此问题进行了探讨,提出了引入专家责任弥补现行法律的不足。本文分为三个部分,主要内容如下:在第一部分中,本文介绍了商标代理相关的现行法律制度、相关概念,并且总结了一部分实践中的案例以及通过案例可以发现的问题。该部分旨在分析现行法律制度存在的问题。第二部分中,本文对专家责任制度进行了介绍,专家是执业专家应当承担的责任,其的法理基础是专业性较强的行业中,由于一般委托人很难对该行业的知识有所了解,所以要求专家承担更严格的几种特殊义务,在违反这些义务时也需要承担相应责任。商标代理人属于专家的一种,其也有着行业本身的特殊性,引入专家责任制度对商标代理行业进行规制能较好地解决实践当中出现的问题,并且与我国原有法律与体系较为契合。该部分旨在分析在商标代理行业引入专家责任制度的可行性和必要性。而在第三部分中,本文对引入专家责任制度后的商标代理人的义务和责任进行了分类介绍。本文商标代理人的的义务根据相对方的不同可以分为对委托人应当承担的义务以及对委托人之外的相关第三人应当承担的义务。两种义务的基础并不相同,并且内容也有所不同。而商标代理人在未妥善履行上述义务时,有可能引发其专家责任。而商标代理人应对委托人和相关代理人承担的专家责任的基础、构成要件、具体内容也有着差异。
[Abstract]:Trademark application and other activities are highly professional. If it involves judging whether the trademark is likely to be registered, it will require a large amount of relevant professional knowledge and experience. Therefore, in practice, a large number of enterprises and market entities will choose to hire trademark agents to handle trademark related matters. With the development of our economy and social progress, on the one hand, Domestic enterprises and all kinds of market entities have also become increasingly aware of the importance and economic value of trademarks for the development of enterprises. On the other hand, today, when the domestic market is increasingly open to the outside world, a large number of foreign enterprises, The company has entered or is entering the Chinese market, and according to the provisions of the Trademark Law, foreign enterprises or foreign citizens cannot directly apply for trademark registration or other administrative procedures related to trademarks in China, The trademark agency must be entrusted to handle it. These factors have promoted the vigorous development of the trademark agency industry in China. At present, the trademark agency industry in our country has also become stronger, reaching to the top international law firms. For example, Magic Circle Law Firmsin the UK, White Shoes Law Firmsin the United States, and small trademark agencies down the street, are all involved in trademark agency activities. Although the trademark agency market in China has a certain scale, it is still a young and immature market. There is also a large number of trademark agents in the practice of misconduct phenomenon. But at present, there are few regulations on trademark agents in our country, resulting in the rights and interests of related persons can not be fully protected. This article is divided into three parts: in the first part, this paper introduces the current legal system related to trademark agency, related concepts, This part aims to analyze the problems existing in the current legal system. In the second part, the author introduces the expert liability system. Experts are professional experts should bear the responsibility, its legal basis is more professional industry, because the general client is very difficult to understand the knowledge of the industry, so experts are required to undertake more stringent several special obligations. In violation of these obligations, they also have to bear the corresponding liability. Trademark agents belong to one of the experts, and they also have the particularity of the industry itself. The introduction of expert liability system to regulate the trademark agency industry can solve the problems in practice. The purpose of this part is to analyze the feasibility and necessity of introducing expert liability system in trademark agency industry. This paper introduces the duties and responsibilities of trademark agents after introducing the system of expert liability. The obligations of trademark agents can be divided into the obligations to the principal and to the commission according to the different parties. Obligations to be assumed by a third person other than a trust. The basis of the two obligations is not the same, And the content is also different. When the trademark agent fails to properly fulfill the above obligations, it may lead to its expert responsibility. And the basis of the trademark agent's expert responsibility to the principal and the relevant agent, the constituent elements, The concrete content also has the difference.
