亲权社会化及其民法典应对

【摘要】：在父母侵害儿童权益时或父母因经济原因无力行使亲权时,意思自治原则支配下的民法亲子监护制度不能按照子女最佳利益原则对儿童权利提供有效保护。该问题的解决依赖于亲权制度的社会化改造,其主要内容包括儿童最佳利益原则的确立、社会介入主体的确定、介入条件以及介入方式的明确等。我国民法典亲子监护制度应按照亲权社会化要求从以下两个方面进行完善:一是将儿童发展局作为唯一社会介入主体并确定其职责,二是规定具体的社会发现、社会支持、社会干涉条件与具体措施。民法亲子监护制度进行社会化再造后,其体系构成包括民法典中的一般规定以及未成年人保护法等相关法律的特别规定。
[Abstract]:When parents infringe upon children's rights or parents are unable to exercise parental rights for economic reasons, the system of parental guardianship under the principle of autonomy of will can not provide effective protection for children's rights according to the principle of the best interests of children.The solution of this problem depends on the socialized transformation of parental right system. Its main contents include the establishment of the principle of the best interests of children, the determination of the main body of social intervention, the condition of intervention and the clarity of intervention mode, etc.The system of parent-child guardianship in civil code of our country should be perfected from the following two aspects according to the requirement of socialization of parental power: first, taking the Child Development Bureau as the sole main body of social intervention and determining its responsibility; second, stipulating specific social discovery and social support.Social intervention conditions and specific measures.After the system of paternity and child custody of the civil law has been reconstituted, its system consists of the general provisions of the civil code and the special provisions of the relevant laws such as the protection of minors.
