填海造地过程中集体滩涂财产权益保护问题研究

【摘要】：20世纪80年代以来,随着我国房地产市场的建立以及土地资源的稀缺,填海造地成为开发增量建设用地的新型方式,大量集体滩涂被征占。国家征收集体滩涂使农民集体丧失了滩涂所有权、滩涂用途变更收益权、农民失则去了滩涂养殖生存权。但法律对集体及农民权益的保护却不容乐观,填涂造地过程中集体滩涂财产权益保护法律制度存在着缺陷与不足,不适应对集体滩涂财产权益保护法治化的制度需求,需要立法的完善。
[Abstract]:Since 1980s, with the establishment of real estate market and the scarcity of land resources in China, reclamation has become a new way to develop incremental construction land, and a large number of collective tidal flats have been collected and occupied. The national expropriation of collective beach makes the peasants lose the ownership of the beach collectively, the right to change the income from the use of the beach, and the peasants lose the right to live in the tidal flat. However, the protection of collective and peasants' rights and interests by law is not optimistic. In the process of land reclamation, there are defects and deficiencies in the legal system of property rights and interests protection of collective beach land, which does not meet the needs of the legal system for the protection of property rights and interests of collective beach flats. Legislation needs to be perfected.
