【摘要】：随着互联网的发展,网络经济也伴随而生,个人网店作为网络经济中的代表性产物,给传统的购物模式带来了全新的变革。个人网店因其灵活便捷的经营模式得到了迅速的发展,并对社会经济生活产生了重大影响,然而在国家立法层面,并没有对个人网店的法律地位进行明确规定,而各个地方的立法规定则不尽相同,这使得个人网店法律地位在我国处于空白状态,同时也引起理论界和实务界的广泛争议。本文主要围绕个人网店法律地位构建,分为三个部分,依次从个人网店的现状和问题,确立个人网店法律地位的必要性和正当性,个人网店的法律地位的构建来研究和讨论：第一部分是个人网店的概述,首先,对个人网店进行理论研究的基础性概念问题进行界定,介绍了个人网店在电子商务中所处的模式,其次,研究了什么是个人网店,以及个人网店的优越性和局限性,并分析个人网店的立法现状和实践现状,引出其中存在的问题。第二部分是对明确个人网店法律地位的必要性和正当性分析。首先分析了个人网店与网络交易平台、交易相对人之间的法律关系,在此基础上,分析个人网店在网络交易中的法律地位。其次,从个人网店、消费者、监管机关的角度出发,用实证分析的方式说明个人网店法律地位缺失所造成的影响。接着,从维护网络交易自由和安全,以及商个人制度的角度出发,指出明确个人网店法律地位的理论基础。第三部门是个人网店法律地位的相关制度构建。对商事主体进行辨析,明确个人网店应当被定位为商事主体,并且通过对个体工商户和个人独资企业的对比分析,认定个人网店应纳入个体工商户的范畴,最后,鉴于个人网店的特殊性,为个人网店进行工商登记的条件和内容、程序提出相关的设计和构想
[Abstract]:With the development of the Internet, the network economy has also been born. As the representative product of the network economy, personal online store has brought new changes to the traditional shopping mode. Because of its flexible and convenient management mode, personal online store has been developed rapidly and has a great impact on social and economic life. However, in the national legislation level, there is no clear regulation on the legal status of individual online store. The legislative provisions of various places are not the same, which makes the legal status of personal online shop in our country blank, but also caused extensive controversy in the theoretical and practical circles. This article mainly revolves around the personal net shop legal status construction, divides into three parts, from the personal net shop present situation and the question in turn, establishes the personal net shop legal status necessity and the legitimacy, the personal net shop legal status construction research and the discussion: The first part is the summary of personal online store. Firstly, it defines the basic concept of personal online store, introduces the model of personal online store in electronic commerce, and then studies what is personal online store. And the advantages and limitations of the personal online store, and analyzes the current legislative and practical status of the personal online store, leading to the existing problems. The second part is the analysis of the necessity and legitimacy of clarifying the legal status of personal online store. This paper first analyzes the legal relationship between the personal online store and the online trading platform and the relative person, and then analyzes the legal status of the personal online store in the online transaction. Secondly, from the point of view of personal online store, consumer and regulatory authority, this paper explains the impact caused by the lack of legal status of personal online store by the way of empirical analysis. Then, from the point of view of safeguarding the freedom and security of online transactions and the individual business system, this paper points out the theoretical basis for clarifying the legal status of personal online stores. The third part is the legal status of personal online shop related system construction. Through the comparative analysis of individual businesses and sole proprietorship enterprises, it is concluded that individual online shops should be included in the category of individual industrial and commercial households. In view of the particularity of the personal online store, the conditions and contents of the business registration for the personal online store are discussed, and the relevant design and conception of the procedure are put forward.
