浅析新业态背景下知识产权保护的若干新问题

【摘要】：随着经济和科技的发展,市场需要更加多样、个性化的服务,顺应新的消费趋势,跨界融合的新业态就应运而生。文章从新业态定义出发,指出在新业态背景下,行业融合加快,商业模式和商业方法发生的巨大变化,知识产权创新的特定主体变得不特定,使得对创新主体的知识产权保护产生困难,也使得侵权主体更加泛化,此外,还存在专利审查授权时间长和专利技术更新快之间的矛盾,以及知识产权收益分配制度缺失、商标跨界融合导致商标显著性降低及商标分类不够细化等一系列知识产权保护存在的新问题。
[Abstract]:With the development of economy and science and technology, the market needs more diversified, individualized service and conform to the new consumption trend. Starting from the definition of new business form, this paper points out that under the background of new business situation, industry convergence is accelerated, business model and business method have changed greatly, and the specific subject of intellectual property innovation has become not specific. It makes it difficult to protect the intellectual property rights of the innovation subject, and makes the infringement subject more extensive. In addition, there is a contradiction between the long time of patent examination and authorization and the fast renewal of patent technology, and the lack of the system of distribution of intellectual property rights income. A series of new problems exist in the protection of intellectual property, such as the decrease of trademark significance and the insufficient refinement of trademark classification due to the cross-border integration of trademarks.
