数字网络环境下我国图书馆合理使用制度的反思与重构

【摘要】：世界主要国家、地区和国际组织都极其重视数字网络环境下图书馆合理使用制度的调整或重构,这些立法均在努力恢复版权平衡,图书馆合理使用空间总体呈扩充趋势。目前,我国《著作权法》给予图书馆的合理使用空间已过于狭窄,严重制约了数字网络环境下图书馆职能的发挥,不利于图书馆获得和传播文献信息资源,亟须适度拓展。在数字网络环境下,图书馆合理使用的制度需求包括:可使用即可保存,善意规避技术措施,非营利有限范围传播作品,适用三步检验法等。基于上述制度需求,我国《著作权法》对于图书馆合理使用相关条款应进行相应修改。
[Abstract]:Major countries, regions and international organizations in the world attach great importance to the adjustment or reconstruction of the reasonable use system of libraries under the environment of digital network. These legislations are striving to restore the balance of copyright, and the reasonable use of space for libraries generally shows a trend of expansion. At present, the reasonable use space given by copyright Law in our country is too narrow, which seriously restricts the function of library under the environment of digital network, and is unfavorable for library to obtain and disseminate literature and information resources, so it is urgent to expand appropriately. In the environment of digital network, the system needs of the reasonable use of library include: using can be preserved, avoiding technical measures in good faith, spreading works on the limited scope of non-profit, and applying the three-step test method and so on. On the basis of the demand of the above system, the relevant articles on the rational use of libraries should be amended in China's copyright Law.
