论网络游戏虚拟财产的民事法律保护

【摘要】：人类已步入信息时代,随着互联网技术的发展,依托于网络空间的网络游戏应运而生,玩家与网络游戏运营商等关联方因网络游戏而引发的网络游戏虚拟财产分歧意见不和谐因素等也随之而来。有数据显示,网络游戏这一新兴的产业发展势头迅猛,蕴含着巨大的经济潜力,以韩国为例,游戏产业逐渐成为韩国支柱性产业。然而在我国,由于缺乏法律的认可和保护,网络游戏虚拟财产引发的纠纷也纷至沓来。当前法律理论界虽然没有对网络游戏虚拟财产形成法律性质的定论,但网络游戏虚拟财产各方基于虚拟物的权利需要而获得法律保障的权利却是毋庸置疑的。权利离开法律制度的保障便是一纸空文,只有通过法律制度的禁止并制裁侵权行为才能保证权利的正当行使。若不能公正公平的保护网络游戏虚拟财产,那么不仅会侵害了玩家的合法财产权利,同时也打击了网络游戏服务商,削弱了游戏产业的发展壮大,最终制约国民经济的发展。因此,网络游戏的虚拟财产的民事法律保护是值得研究的法律问题。当前我国在网络游戏虚拟财产方面面对的压力主要是其法律属性和界定不清晰,从而导致缺乏充分的法律保护,本文以此为切入点,首先对网络游戏虚拟财产做概念特征的分析,有助于对网络游戏虚拟财产作本质上的了解。再分析网络游戏虚拟财产的性质,本文引用当前多数学者主张的网络游戏虚拟不同的财产性质说,并评析各类观点,笔者结合网络游戏虚拟财产自身的特征,提出网络游戏虚拟财产应当属于物权范畴。接着分析我国对网络游戏虚拟财产的保护现状,通过立法现状与司法实践两方面论证分析,归纳出现今领域存在的问题。文章的最后部分是提出对网络游戏虚拟财产保护的完善措施。
[Abstract]:Human beings have entered the information age, with the development of Internet technology, online games based on cyberspace came into being. Players and online game operators and other related parties due to online games caused by the online game virtual property differences of opinion discordant factors and so on. Some data show that the online game industry is developing rapidly, which contains great economic potential. Taking Korea as an example, the game industry has gradually become a pillar industry in South Korea. However, in our country, due to the lack of legal recognition and protection, online games caused by virtual property disputes also poured in. Although there is no conclusion on the legal nature of virtual property of online games in the current legal theoretical circle, the rights of parties to virtual property of online games to obtain legal protection based on the rights of virtual objects are beyond doubt. The protection of the right from the legal system is a dead letter, only through the prohibition of the legal system and sanctions of infringement can ensure the legitimate exercise of rights. If the virtual property of online games cannot be protected fairly and fairly, it will not only infringe on the legitimate property rights of the players, but also attack the online game service providers, weaken the development and growth of the game industry, and ultimately restrict the development of the national economy. Therefore, the legal protection of virtual property of online games is worth studying. At present, the pressure on virtual property of online games in our country is mainly due to its unclear legal attributes and definition, which leads to a lack of adequate legal protection. Firstly, it is helpful to understand the essence of virtual property of online games by analyzing the conceptual characteristics of virtual property of online games. After analyzing the nature of virtual property of online game, this paper cites the theory of different property of virtual property of online game advocated by most scholars at present, and comments on all kinds of viewpoints. The author combines the characteristics of virtual property of online game with its own characteristics. The virtual property of online games should belong to the category of real right. Then it analyzes the current situation of the protection of virtual property of online games in our country, and concludes the problems existing in the present field through the analysis of legislative status and judicial practice. The last part of the article is to put forward the measures to improve the virtual property protection of online games.
