远程购物消费者后悔权制度研究

【摘要】:随着网络的发展和普及,人们的消费方式、消费结构和消费理念都发生了翻天覆地的变化,网络购物已经成为人们生活中不可或缺的一部分。《2014年中国网络购物行业年度监测报告》显示,2013年度中国网络购物市场继续保持快速发展的态势,全年网购交易额达到1.84万亿,同比增长39.4%,在社会零售品总额中所占比例为7.9%。网购给人们的生活带来了很多方便,但网购消费者对于网购的投诉却与日俱增。所以国家对网购中消费者权益的保护非常重视,2013年4月23日的十二届全国人大常委会审议了新《消费者权益保护法》的草案,2014年3月15日新《消费者权益保护法》正式实施。该法首次赋予了消费者在非现场购物情形下享有后悔权,即“有权自收到商品之日起七日内无理由退货”。这显著降低了消费者网购的风险,加强了网购中消费者权益的保障。但是,目前新《消法》还不够完善,在实施过程中产生了许多问题。 鉴于此,文章分为四个部分进行论述,第一部分对消费者后悔权制度提出了一个理论界定,并分析了后悔权的特征和适用范围;第二部分探索了我国现行消费者后悔权制度实施的现状及存在的主要问题,这些问题包括:适用范围不明确、商品完好理解太模糊、消费者滥用后悔权未受到限制、退回商品损坏的责任承担未明确;第三部分采用比较分析的研究方法,介绍了德国、英国、美国以及其他国家和地区成熟的后悔权制度,并在通过比较后得出了完善我国消费者后悔权制度的启示,一是立法明确、建立了完备的后悔权制度体系,二是强化责任、处罚方式多样化,三是广泛动员社会力量参与消费者保护工作;最后一个部分采用综合分析的研究方法,提出了完善消费者后悔权制度的三个建议——细化条款、明确并强化责任追究、设立相关的配套保障制度。众所周知,《消费者权益保护法》的法律价值就在于最大限度的保护消费者的合法权益,所以,建立健全消费者后悔权这一具有倾斜保护性质的制度,不仅能够丰富消费者权利类型、完善我国法律制度,而且对于切实保护消费者合法权益、维护市场经济公平秩序等也是有百利无一害的。
[Abstract]:With the development and popularization of the network, people's consumption patterns, consumption structure and consumption concepts have undergone earth-shaking changes. Online shopping has become an indispensable part of people's lives. The annual monitoring report of China's online shopping industry in 2014 shows that China's online shopping market continued to maintain a rapid development trend in 2013, with the total value of online shopping transactions reaching 1.84 trillion in the whole year. Year-on-year growth was 39.4%, accounting for 7.9% of total social retail sales. Online shopping has brought a lot of convenience to people's lives, but online shopping consumers are increasingly complaining about online shopping. Therefore, the state attaches great importance to the protection of consumers' rights and interests in online shopping. On April 23, 2013, the standing Committee of the 12th National people's Congress considered the draft of the new Consumer Rights and interests Protection Law, which came into effect on March 15, 2014. For the first time, the law gives consumers the right to regret off-site purchases, that is, "the right to return goods without reason within seven days from the date of receipt". This significantly reduces the risk of consumer online shopping, strengthen the protection of consumer rights and interests in online shopping. However, at present, the new law is not perfect enough, and many problems have arisen in the process of implementation. In view of this, the article is divided into four parts to discuss, the first part of the consumer regret right system proposed a theoretical definition, and analyzed the characteristics of regret rights and the scope of application; The second part explores the current situation and main problems of the implementation of the current consumer regret right system in China. These problems include: the scope of application is not clear, the good understanding of goods is too vague, and the abuse of the right of regret by consumers is not restricted. The third part introduces the mature regret rights system of Germany, the United Kingdom, the United States and other countries and regions. Through comparison, the author draws the enlightenment of consummating the system of consumer's right of regret in our country. One is that the legislation is clear, the other is the establishment of a complete system of the right of regret, the second is to strengthen the responsibility, and to diversify the way of punishment. Third, mobilize social forces extensively to participate in the work of consumer protection. The last part, using the research method of comprehensive analysis, puts forward three suggestions to perfect the system of consumers' right of regret, that is, to refine the clauses, to clarify and strengthen the accountability, Establish relevant supporting safeguard system. As we all know, the legal value of the Consumer Rights and interests Protection Law lies in maximizing the protection of the legitimate rights and interests of consumers. Therefore, we should establish and improve the system of consumer repentance, which is of an inclined nature of protection. It can not only enrich the types of consumer rights, perfect our legal system, but also have no harm to protect the legitimate rights and interests of consumers and maintain the fair order of market economy.
