网络视听作品著作权的归属与使用问题研究

【摘要】：著作权的研究范围十分广泛,不仅包括传统意义上的著作权,也包括网络著作权,传统意义上的著作权大家都较为熟悉,所以本文将重点介绍关于对网络视听作品著作权的研究。网络的发展日新月异,带给我们便利,提高生活的节奏,加快了人类文明成果的传扬与发展。但是网络也是一把双刃剑,网络的虚拟性,局限性让我们看到了它的弊端。随着经济全球化,世界多极化的发展趋势,世界各地的文明成果资源共享,网络的运用更加广泛,随之而来网络著作权的话题讨论也更加频繁。我国《著作权法》保护的作品是指文学,艺术以及科学领域内专有,独创的智力成果。《著作权法》从保护文字作品延伸到相片,影像,软件等多媒体作品,得到法律的保护,同时也受到法律的制约。近年来,因网络著作权而引起的纠纷案件不绝于耳,人们在享受网络带来的便利同时也时刻需反省其带来的弊端。但在网络著作权在法律方面的规定却存在一些不足的地方,例如侵权形式,对著作权人人身保护方面。本文将通过以下几个观点,阐明对网络著作权的理解:网络著作权的归属,网络著作权归属的特殊问题以及归属后的合理使用问题等。
[Abstract]:The scope of copyright research is very extensive. It includes not only copyright in the traditional sense, but also network copyright. In the traditional sense, everyone is familiar with copyright. Therefore, this paper will focus on the network audio-visual works copyright research. The rapid development of the network brings us convenience, improves the rhythm of life, and speeds up the spread and development of the achievements of human civilization. But the network is also a double-edged sword, the virtual nature of the network, limitations let us see its drawbacks. With the globalization of economy and the trend of multipolarization in the world, the resources of civilization achievements are shared all over the world, the application of network is more extensive, and the topic of network copyright is discussed more frequently. The works protected by the copyright Law of China refer to the exclusive and original intellectual achievements in the field of literature, art and science. The copyright Law extends from protecting written works to multimedia works such as photographs, images, software, and so on, and is protected by law. At the same time, it is also restricted by the law. In recent years, the disputes caused by the network copyright cases are endless, people enjoy the convenience brought by the network, but also need to reflect on its disadvantages. However, there are some deficiencies in the legal provisions of network copyright, such as the form of infringement and the protection of the copyright owner's habeas corpus. This paper will clarify the understanding of network copyright through the following points of view: the ownership of network copyright, the special problems of network copyright attribution, and the reasonable use of network copyright after attribution.
