公有制下国家所有权制度的变革和完善

【摘要】：我国公有制下的国家所有权面临权利主体不清、公权私权不分、人民受益不足等诸多现实问题,因此需要根据发展了的社会主义理论和市场经济规则重构这一制度。在坚持公有制和全民权利、全民利益的原则下,改"国家所有权"为"国家财产权",还原国家财产权的本质属性;区分国有公物和国有私物,赋予不同公法主体法人财产权和国有企业独立财产权,实行不同的国有财产治理方式,尤其是构建现代企业制度,以市场配置资源,是理顺国有财产法律关系、实现社会公平正义的重要举措。
[Abstract]:The state ownership under the public ownership in our country is confronted with many practical problems, such as unclear subject of rights, no division of public rights and private rights, insufficient benefit to the people and so on. Therefore, it is necessary to reconstruct this system according to the developed socialist theory and the rules of market economy. Under the principle of upholding public ownership, the rights of the whole people and the interests of the whole people, we should change "state ownership" to "state property right" and restore the essential attribute of state property right; Distinguishing state-owned public property from state-owned private property, giving legal person property rights of different public law subjects and independent property rights of state-owned enterprises, implementing different ways of governing state-owned property, especially constructing modern enterprise system and allocating resources by market. It is an important measure to straighten out the legal relationship of state-owned property and realize social fairness and justice.
