虚拟财产的价值证明:从传统机制到电子数据鉴定机制

【摘要】：互联网的迅速发展拓展了人类生活的空间,也带来了新的法律问题。虚拟财产犯罪正是网络时代出现的新型犯罪形式,惩治该类犯罪有助于维护网络空间秩序、保护公民虚拟财产权益。如何证明虚拟财产的价值,是虚拟财产犯罪定罪量刑的核心问题。实践表明,司法机关若继续沿用传统的价值证明机制,将遭遇到方法落空等越来越多的挑战。这一问题的深层次原因在于,虚拟财产属于虚拟空间的财产性利益,其价值证明方法必然与物理空间的传统物品存在差异。这就需要引入解决虚拟空间专门性问题的电子数据司法鉴定。无论是从理论上还是从实务上讲,糅合电子数据鉴定知识和物价认定知识的新型电子数据司法鉴定方法,是有效化解虚拟财产价值证明难题的新机制。
[Abstract]:The rapid development of the Internet has expanded the space of human life, but also brought new legal problems. The crime of virtual property is a new type of crime in the age of network. Punishing this kind of crime is helpful to maintain the order of cyberspace and protect the rights and interests of citizens' virtual property. How to prove the value of virtual property is the core problem of crime conviction and sentencing of virtual property. Practice shows that if the judiciary continues to use the traditional value certification mechanism, it will encounter more and more challenges. The deep reason of this problem lies in the fact that virtual property belongs to the property interests of virtual space and its value proof method must be different from the traditional objects in physical space. This requires the introduction of electronic data forensic expertise to solve the problem of virtual space specialization. Whether in theory or in practice, a new electronic data forensic identification method combining electronic data identification knowledge with price determination knowledge is a new mechanism to effectively resolve the problem of virtual property value proof.
