我国住宅小区管理规约法律制度研究

【摘要】:管理规约是住宅小区管理中最根本、核心的要素。我国《物权法》、《物业管理条例》等都对管理规约进行了规定,但是,由于立法过于宽泛,关于小区的管理规约,在理论研究与法律层面上仍有许多问题亟待解决。本文拟从住宅小区管理规约的订立、履行、违反救济三个方面进行研究,以期完善我国的住宅小区管理规约法律制度。第一章分析了我国住宅小区管理规约立法现状与问题。该章通过对我国《物权法》、《物业管理条例》中有关管理规约相关条文的分析,认为在管理规约的订立制度上,存在管理规约的订立条件欠缺规定、规约的制定主体不够明确、规约的具体记载事项规定空白、对订立临时管理规约的规定有失公平等问题;在管理规约的履行制度上,现行立法未规定规约的性质以及规约对除业主外的物业使用人的效力等问题;在管理规约的违反救济制度上,存在对管理规约违反救济的强制性规定和对管理规约违反司法受案范围不够明确的问题,致使各地司法实践混乱,违反规约的行为得不到有效规制。第二章提出了订立管理规约的立法完善建议。该章分析了我国香港地区、日本以及德国的管理规约订立制度,研究并提出了对我国小区管理规约订立制度的完善建议,包括规定管理规约的订立条件、明确管理规约的制定主体、规定管理规约的记载事项、完善临时管理规约内容的公平性、增加对“业主承诺”的特别规定,以期管理规约能够更好地订立,使小区管理有章可循。第三章是对管理规约履行立法完善的思考。该章考察分析了日本和德国的管理规约履行制度,研究并提出以下两点对完善我国规约履行制度的建议,包括完善管理规约的效力规定、增补管理规约实施监督机制,希望通过上述建议促进管理规约的履行力度,发挥其规范作用。第四章是对管理规约违反救济立法完善的思考。该章分析了台湾地区和日本的管理规约违反救济制度,研究并提出完善管理规约违反救济的建议,包括明确管理规约违反救济的强制性规定、明确管理规约违反司法受案范围。
[Abstract]:Management regulation is the most fundamental and core element in residential district management. In our country, the property Law and the property Management regulations have stipulated the management rules. However, because the legislation is too broad, there are still many problems to be solved in the theoretical research and the legal level. This paper intends to make a study on the establishment, implementation and violation of the regulations of residential district management in order to perfect the legal system of the statute of residential district management in our country. The first chapter analyzes the legislation status and problems of residential district management statute in China. Based on the analysis of the relevant articles in the property Law and property Management regulations of our country, it is concluded that there is a lack of conditions for the establishment of the management statute in the system of making the management statute. The main body of making the statute is not clear enough, the specific record of the statute stipulates the blank, the stipulation of establishing the interim management statute is unfair and so on; In the implementation system of the management statute, the current legislation does not stipulate the nature of the statute and the effectiveness of the statute on the property users other than owners. In the system of remedy for the violation of the administrative statute, there are the problems of the mandatory provisions for the remedy of the violation of the statute and the lack of clarity in the scope of the cases of the violation of the law, which cause confusion in the judicial practice in various parts of the country. Violations of the statute can not be effectively regulated. In the second chapter, the author puts forward some suggestions to perfect the legislation. This chapter analyzes the establishment system of the management statute in Hong Kong, Japan and Germany, studies and puts forward some suggestions to perfect the establishment system of the management statute in our country, including the stipulation of the conditions for the establishment of the management statute. Making clear the subject of the management statute, stipulating the contents of the management statute, perfecting the fairness of the content of the interim management statute, adding special provisions to the "owner's commitment", so that the management statute can be better formulated. To make the management of the district to follow the rules. The third chapter is a reflection on the legislative perfection of the implementation of the management statute. This chapter examines and analyzes the performance system of Japan and Germany, studies and puts forward the following two suggestions to improve the performance system of China's Statute, including perfecting the effective provisions of the Statute of Management and supplementing the implementation Supervision Mechanism of the Statute of Management. I hope to promote the implementation of the management statute through the above recommendations, and play its normative role. The fourth chapter is to the management statute violation relief legislation consummation ponder. This chapter analyzes the relief system of the violation of the statute of management in Taiwan and Japan, studies and puts forward some suggestions on how to improve the remedy of the violation of the statute of management, including the mandatory provisions of the remedy for the violation of the statute of management, and the scope of the case of the violation of the statute of administration.
