我国海难救助报酬内部分配制度研究

【摘要】:海难救助报酬能否公平合理的分配是海难救助制度能否长远健康发展的关键,但我国《海商法》只针对多个救助方之间的外部报酬分配做了规定,对同一救助方内部分配只字未提。本文本着“以人为本”和有利于海难救助制度长远发展的理念,对救助报酬同一救助方内部分配做了系统、全面和比较深入的研究。 本文以经济学、法理学、法律经济学和经济法学的基础理论作为指导,立足于我国航运市场经济的现实和社会主义市场经济体制下海难救助对法律的内在需求,充分运用经济法理论研究的成果,借鉴欧美和日韩海难救助制度研究的成果和先进的立法例,以马克思主义的法学研究方法为指导,遵循整体性原则、互联性原则、有序性原则和动态性原则的系统研究方法,以及适合性与移植性、实证性与假设性相结合的研究方法,论证了船东、船长、船员、货主的救助报酬请求权的合理性,总结得出同一救助方内部各方报酬分配的原则、方法、救济途径,不但充分满足了各方的利益诉求,而且可操作性强,易于推广实施。 本文共三大部分,包括引言、正文、结论,其中正文由三章构成: 第一部分引言,主要阐述了提出本文主题的缘由,表明研究的范围及意义所在。 正文第一章为海难救助报酬基本理论问题,介绍分析了我国海难救助报酬制度的概况,运用经济法理论研究的成果,针对海难救助制度的特殊性,分析和论述了海难救助报酬的意义、性质、分配及与其他法律的关系和价值区别,从而提出同一救助方内部分配的必要性。 正文第二章为船东、船员之间的救助报酬分配问题。介绍分析了当下我国船东和船员之间救助报酬分配的现状,针对目前存在的问题提出了双方之间救助报酬分配的原则,操作方法和法律救济途径,提出了关于这些方面立法的一些建议。 正文第三章为货主的救助报酬分配问题。以法理精神为依据,以海商法发展趋势和市场经济发展的要求为指导,提出了货主救助报酬分享权的依据,并借鉴相关国家和一些标准合同的规定,提出了对货主报酬分配的操作方法,明确阐述了赋予货主救助报酬的意义所在。 最后一部分是结论,是对全文所做的总结。
[Abstract]:Whether the compensation of salvage at sea can be allocated fairly and reasonably is the key to the long-term and healthy development of salvage system, but the maritime law of our country only provides for the distribution of external remuneration among multiple salvage parties. There is no mention of the internal distribution of the same salvage party. This paper, based on the concept of "people-oriented" and conducive to the long-term development of the salvage system, makes a system for the internal distribution of the same salvage party. A comprehensive and more in-depth study. This paper is guided by the basic theories of economics, jurisprudence, legal economics and economic law. Based on the reality of our country's shipping market economy and the inherent demand of shipwrecked rescue to the law under the socialist market economy system, we make full use of the research results of the economic law theory. Draw lessons from European, American and Japan-Korea salvage system research results and advanced legislation, guided by Marxist legal research methods, follow the principle of integrity and interconnection. The systematic research methods of order principle and dynamic principle, as well as the combination of suitability and portability, positivism and hypothesis, demonstrate the shipowner, captain and crew. The reasonableness of the owner's right to ask for compensation for salvage summarizes the principles methods and ways of compensation distribution within the same salvage party which not only fully meet the interests of all parties but also have strong maneuverability. Easy to popularize and implement. There are three parts in this paper, including introduction, text and conclusion, in which the text is composed of three chapters: The first part introduces the reason of putting forward the theme of this paper, and shows the scope and significance of the study. The first chapter is the basic theory of compensation for salvage at sea. It introduces and analyzes the general situation of the compensation system of salvage at sea in China, and applies the results of the theory of economic law, aiming at the particularity of salvage system at sea. This paper analyzes and discusses the significance, nature, distribution, relationship and value difference between the remuneration of salvage at sea and other laws, and puts forward the necessity of the internal distribution of the same salvage party. The second chapter is about the distribution of salvage reward between ship owner and crew. It introduces and analyzes the present situation of salvage reward distribution between ship owner and crew in our country. In view of the existing problems, this paper puts forward the principles, operation methods and legal remedies for the distribution of salvage reward between the two sides, and puts forward some suggestions on the legislation of these aspects. The third chapter is about the distribution of salvage reward for the owner. Based on the spirit of law and the development trend of maritime law and the requirements of market economy, the author puts forward the basis of the right of the owner to share the compensation for salvage. With reference to the relevant countries and some standard contracts, this paper puts forward the operating method of the distribution of the owner's remuneration, and clearly expounds the significance of giving the owner the reward for salvage. The last part is the conclusion, is the summary of the full text.
