港口经营人留置权实现的法律问题研究

【摘要】：港口经营人在完成合同约定任务的情况下,如果债务人不履行相应义务,便会选择留置债务人的财产。纵观各国的法律,无论是航运法律的制定,还是航运法律的研究,对运输方面的研究强于港口方面,我国也不例外。我国先后出台了《中华人民共和国海商法》(以下简称《海商法》)、《水路货物运输规则》等有关运输方面的法律,在明确有关运输方面的纠纷起到了重要作用。随着运输方面的法律逐渐完善,有关港口方面的纠纷开始增多,于是我国出台了《中华人民共和国港口法》(以下简称《港口法》)来明确港口方面的问题,但是这部法律对港口经营人的规定并不十分明确,导致港口经营人在实现留置权过程中遇到各种问题,阻碍了港口经营人留置权的实现。本文主要分为四个部分来研究港口经营人留置权实现的法律问题。第一部分,从留置权的概念引出港口经营人留置权的概念,对港口经营人的法律地位问题做简单论述；第二部分,探讨港口经营人在实现留置权过程中所具有的特殊性；第三部分,主要研究港口经营人在实现留置权过程中遇到的一些难点问题,包括港口经营人留置标的物的归属问题、价值问题、集装箱的有关问题以及港口经营人在实现留置权过程与其他法律的冲突问题；第四部分,针对上述问题的存在,这部分的内容主要是对港口经营人更好地实现留置权提出一些建议,主要包括完善留置期间的建议、完善留置标的物所有权的建议以及赋予港口经营人紧急留置权的建议。
[Abstract]:If the debtor fails to perform the corresponding obligations, he will choose to keep the debtor's property. The study of shipping law is stronger than that of the port, and China has issued the Maritime Law of the people's Republic of China (hereinafter referred to as "Maritime Law"). The regulations on waterway cargo transport and other laws on transport have played an important role in clarifying the disputes concerning transport. With the gradual improvement of the laws in the field of transport, the disputes concerning ports have begun to increase. As a result, China issued the Port Law of the people's Republic of China (hereinafter referred to as the Port Law) to clarify the port issues, but the provisions of this law for port operators are not very clear. As a result, port operators encounter various problems in the process of realizing the lien, which hinders the realization of the lien. This paper is divided into four parts to study the legal issues of the realization of the port operator lien. In the first part, from the concept of lien, the concept of port operator lien is introduced, and the legal status of port operator is simply discussed. The second part discusses the particularity of the port operator in the process of realizing the lien. The third part mainly studies some difficult problems encountered by the port operator in the process of realizing the lien, including the ownership of the subject matter of the port operator's lien and the value problem. Issues related to containers and conflicts between port operators and other laws in the process of realizing liens; Part 4th, aiming at the existence of the above problems, the content of this part is mainly to put forward some suggestions for the port operators to better realize the lien, mainly including the suggestion of perfecting the lien period. The suggestion of perfecting the title of the subject matter and granting the emergency lien to the port operator.
