论国际海事诉讼管辖权的冲突及协调

【摘要】：海事诉讼是一项特殊的诉讼制度,海事诉讼的管辖权问题更是一个内容丰富而复杂的重要课题。它不仅包含对国内具体海事诉讼管辖的分类与分配,在国际海事诉讼领域,管辖权冲突的协调与解决,对国际海商法的统一起着“铺路石”的作用。本文从海事诉讼管辖的概念特点入手,对国际海事诉讼管辖权的基本理论作出初步的论述。对于理论研究中所普遍关注的国际海事诉讼管辖及其冲突,通过分析其产生冲突的原因,对解决冲突的途径发表了自己的若干看法。对于海事诉讼的协议管辖,结合其在海事诉讼中的特有表现形式——提单管辖权条款进行了一定的阐述,并对于我国在司法实践中处理海事管辖权条款问题的不统一现象提出些可供深入讨论的问题。同时,对于我国入世之后的海事诉讼管辖原则、制度的改革和调整提出了相关建议。本文分为四个部分。第一部分首先比较了海事诉讼管辖权与国际海事诉讼管辖权的概念和特点的差别,再从事实和法律两个方面分析了国际海事诉讼管辖权的确立依据。第二部分论述了国际海事诉讼管辖权冲突的产生原因及类型。海事管辖权冲突有积极冲突和消极冲突之分。第三部分分析了国际海事诉讼管辖权冲突的协调机制,并从国际海事管辖权冲突的避免方法和解决方法两方面加以论述。第四部分就我国有关海事诉讼管辖权理念与司法实践的变革提出了若干建议。
[Abstract]:Maritime litigation is a special litigation system, and the jurisdiction of maritime litigation is an important and complicated subject. It not only includes the classification and distribution of domestic specific maritime litigation jurisdiction, but also the coordination and resolution of jurisdiction conflicts in the field of international maritime litigation, which plays a "paving stone" role in the unification of international maritime law. Starting with the concept and characteristics of jurisdiction of maritime action, this paper makes a preliminary discussion on the basic theory of jurisdiction of international maritime action. For the jurisdiction of international maritime litigation and its conflicts which are generally concerned in the theoretical research, this paper analyzes the causes of the conflicts, and puts forward some views on the ways to resolve the conflicts. As for the agreement jurisdiction of maritime action, combined with its unique manifestation in maritime litigation-the clause of jurisdiction of bill of lading, Some problems for further discussion are put forward to deal with the disunity of maritime jurisdiction clause in judicial practice in our country. At the same time, some suggestions on the reform and adjustment of maritime litigation jurisdiction after China's entry into WTO are put forward. This paper is divided into four parts. The first part first compares the concept and characteristics of maritime litigation jurisdiction and international maritime litigation jurisdiction, and then analyzes the establishment basis of international maritime litigation jurisdiction from two aspects of fact and law. The second part discusses the causes and types of jurisdiction conflicts in international maritime litigation. There are positive conflicts and negative conflicts in the conflicts of maritime jurisdiction. The third part analyzes the coordination mechanism of the conflicts of international maritime jurisdiction, and discusses the ways of avoiding the conflicts of international maritime jurisdiction and the methods of solving them. The fourth part puts forward some suggestions on the reform of the concept and judicial practice of maritime litigation jurisdiction in China.
