国际货物多式联运的法律调整

【摘要】: 随着集装箱运输的迅猛发展和物流经济的勃兴,国际货物多式联运在经济全球化过程中的作用愈发重要。国际货物多式联运自诞生以来,一直呼唤着法律上的国际统一。由于各种运输方式受制于装备水平、风险程度乃至地缘政治等因素,所适用的国际规则和国内立法在制度上存在显著差异。虽然联合国、国际商会等国际组织在此方面已积极探索,但迄今为止仍未能形成一部具有法律效力的国际货物多式联运公约,极大地制约了国际多式联运业的发展。 本文从海商法和多式联运法律的基本理论出发,重点论述了多式联运法律适用的规则,即网状责任制和统一责任制的区别。本文以历史分析的方法对历史上关于多式联运的立法实践,尤其是1980年联合国货物多式联运公约进行分析和评述,并结合最新运输法草案和我国国内法关于多式联运的规定,对多式联运法律制度进行分析,吸收其精华总结失败的教训尤其是1980年多式联运公约的失败教训,对于成功制订新的国际运输公约有着极其重要的借鉴意义。 而我国在多式联运的立法与学术研究方面比较滞后。目前还没有专门的国际多式联运立法。《海商法》第四章第八节有关多式联运的规定只有5个条款,且其所界定的多式联运必须包括海运,这是为了符合《海商法》的整体架构所作的特殊限制。而不涉及海运的多式联运只能依据《合同法》的一般原理去进行处理。我国现在关于多式联运的立法明显不能满足国际多式联运迅猛发展的商务实践。因此应该与世界接轨并结合中国的实际情况对多式联运制度做出详尽的规定。 文章最后就多式联运的立法提出了一些建议,希望能对我国多式联运制度的完善和发展起到积极作用。
[Abstract]:With the rapid development of container transportation and the prosperity of logistics economy, international multimodal transport of goods plays an increasingly important role in the process of economic globalization. International multimodal transport of goods has been calling for international unification since its birth. Because various modes of transportation are restricted by the equipment level, the degree of risk and even the geopolitical factors, the applicable international rules and domestic legislation have significant differences in system. Although international organizations, such as the United Nations and the International Chamber of Commerce, have actively explored this aspect, up to now, it has not been able to form a legally effective convention on international multimodal transport of goods, which has greatly restricted the development of international multimodal transport industry. Based on the basic theory of maritime law and multimodal transport law, this paper focuses on the rules of the application of multimodal transport law, that is, the difference between the network responsibility system and the unified responsibility system. This paper analyzes and comments the legislative practice of multimodal transport in history, especially the United Nations Convention on multimodal Transport of goods in 1980, and combines with the latest draft Transport Law and the provisions of China's domestic law on multimodal transport. Analyzing the legal system of multimodal transport and absorbing its essence to sum up the lessons of failure, especially the failure lesson of the 1980 multimodal transport convention, is of great significance for the successful formulation of the new international transport convention. In our country, the legislation and academic research of multimodal transport lag behind. There is currently no specific international multimodal transport legislation. Chapter IV, section VIII, of the Maritime Code provides for multimodal transport only five articles, and the multimodal transport as defined therein must include maritime transport, This is a special limitation to conform to the overall structure of the Maritime Code. Multimodal transport, which does not involve sea transport, can only be dealt with according to the general principles of contract Law. China's current legislation on multimodal transport obviously can not meet the rapid development of international multimodal transport business practice. Therefore, the system of multimodal transport should be regulated in detail in line with the world and the actual situation in China. Finally, some suggestions on the legislation of multimodal transport are put forward, hoping to play a positive role in the improvement and development of multimodal transport system in China.
