体育法律修改包裹模式的运用——以学校体育设施社会化开放立法为考察对象

【摘要】：学校体育设施社会化开放制度的实施需要有相应的立法作保障,否则这样的制度就难以得以有效地实施。我国现行教育法律以及体育法律缺少相应的整体性与协调性的规定,需要启动对教育法律以及体育法律的整体修改,即采用包裹立法模式来确立我国的学校体育设施社会化开设的法律制度。包裹立法模式是指为了达到一个整体的立法目的,立法机关在一个法律性文件中对散布在多个法律内的有关规定一次性地作出"打包"修改。体育法律修改的包裹模式的适用不仅能够提高立法效率,还能够保障法律体系内部的协调性。根据我国现行立法体制以及现行教育法律、体育法律存在的不协调的问题,我国采用包裹式体育与教育法律的修改模式是有必要的。从学校体育设施社会化开放立法的角度来看,采用这种模式就要做到:我国现行的《教育法》、《高等教育法》、《职业教育法》、《义务教育法》由全国人大常委会进行整体性修改;《公共文化体育设施条例》、《全民健身条例》与《学校体育工作条例》等行政法规由国务院启动整体修改;地方性法规和规章的制定主体在自己的立法权限范围内启动关于学校体育设施社会化开放的地方立法的整体修改,以实现学校体育设施社会化开放立法的合法性以及协调性,保障学校体育设施社会化开放制度的实施及实效。
[Abstract]:The implementation of the socialized open system of school sports facilities needs to be guaranteed by corresponding legislation. Otherwise, such a system can not be effectively implemented. Our current education law and sports law lack the corresponding integrity and coordination of the provisions, need to start the education law and sports law of the overall revision. That is to say, the package legislation model is adopted to establish the legal system of socialized opening of school sports facilities in our country. The package legislation mode is to achieve a whole legislative purpose. In one legal document, the legislature can make one-off "package" modification of the relevant provisions scattered in many laws. The application of the package mode of sports law amendment can not only improve the efficiency of legislation. It can also ensure the coordination of the legal system. According to the current legislative system of our country and the current education law, sports law is not in harmony. It is necessary for our country to adopt the mode of amending the law of package sports and education. From the point of view of the legislation of socialized opening of school sports facilities, it is necessary to adopt this mode: our country's current "Education Law". "higher Education Law", "Vocational Education Law", "compulsory Education Law" shall be amended by the standing Committee of the National people's Congress; "regulations on Public Cultural and Sports facilities", "regulations on National Fitness for all" and "regulations on School physical Education" and other administrative regulations shall be amended as a whole by the State Council; The main body of local laws and regulations starts the whole revision of the local legislation about the socialization and opening of school sports facilities within the scope of their own legislative competence. In order to realize the legality and coordination of the socialized opening legislation of school sports facilities, the implementation and actual effect of the socialized opening system of school sports facilities can be guaranteed.
