政府法治论的行政制度实践价值

【摘要】：行政制度实践是检验行政法学理论基础的唯一标准。据此标准,"政府法治论"在我国当下行政法学理论基础"各说"中最具实践价值和实践理性。行政制度实践指导性和高度契合性赋予"政府法治论"以实践理性;行政制度实践适应性是"政府法治论"实践价值的前提;在行政制度实践中不断完善是"政府法治论"得以发扬光大的基础;行政制度实践延展性是"政府法治论"的生命力所在。随着"政府法治论"理论自洽性的不断增强,"向行政实践进发"应该成为其将来走向,以使其在"理论自信"的基础之上,进一步通过挖潜制度价值来树立和拓展"制度自信"。
[Abstract]:The practice of administrative system is the only standard to test the theoretical basis of administrative law. According to this criterion, the theory of government ruling by law is the most practical value and practical reason in the theoretical basis of administrative law in China. The guidance and highly consistent nature endow "the theory of government ruling by law" with practical rationality; The adaptability of administrative system practice is the premise of the practical value of the "government rule of law", and the continuous improvement in the practice of administrative system is the basis on which the "government rule of law" can be carried forward. The extension of the practice of administrative system is the vitality of "the theory of government ruling by law". With the increasing self-consistency of the theory of "the theory of government ruling by law", "advancing to administrative practice" should become its future trend. On the basis of "theoretical confidence", we can further establish and expand "institutional confidence" by tapping the potential of institutional value.
